Recreational Fires / Open Burning Guide
Recreational Fires in the City of Marion do not require a permit (except during a burning ban) if they meet the requirements described below, as set forth by the Ohio Fire Code, Ohio Environmental Protection Agency, and City of Marion.

Recreational Fires must meet the following requirements:

  • Must be 3 feet or less in diameter and 2 feet or less in height.
  • Only clean, seasoned fire wood or equivalent shall be used.
  • Shall not be conducted within 25 feet of a structure or combustible material.
  • Conditions which would cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition.
  • Must be constantly attended until the fire is extinguished.
  • Fire extinguishing equipment must be present and available for immediate use: fire extinguisher, garden hose, etc.
  • It is not offensive or objectionable because of smoke or odor emissions.

Recreational Fires in approved containers (Chimineas, outdoor fire places, and other similar products) must meet the following requirements:

  • Only clean, seasoned fire wood or equivalent shall be used.
  • Shall not be conducted within 15 feet of a structure.
  • Must be constantly attended until the fire is extinguished.
  • Fire extinguishing equipment must be present and available for immediate use: fire extinguisher, garden hose, etc.
  • It is not offensive or objectionable because of smoke or odor emissions.

If the Marion Fire Department determines a recreational fire to be “Objectionable” or “Hazardous”, the fire must be immediately extinguished.  If you plan to have a fire that does not meet the above requirements, you must contact the Marion Fire Department to obtain the proper permits.

Be a good neighbor

  • If you are concerned that neighbors might confuse your recreational fire with a destructive one and call 911, you may call the Marion Fire and Police Dispatch Center at (740) 387-2525 and tell them you are having a recreational fire.
  • If a neighbor complains because of smoke or fear of the fire spreading, your fire will be considered “Objectionable” or “Hazardous” and will be extinguished.
  • Keep your fire away from the property line.
  • Use only clean dry wood, don’t allow the fire to smolder, and keep it burning good and hot to minimize smoke.
