ORDINANCE CLARIFYING AND MODIFYING marion city code SECTION 943.19 TITLED EXEMPTION OF SENIOR CITIZENS AND DISABLED PERSONS FROM PAYMENT OF CHARGES RELATING TO DOMESTIC REFUSE AND RUBBISH COLLECTION TO PROVIDE FOR NECESSARY UPDATES IN THE CITY OF MARION

       Whereas, The Administration and the Council has completed an evaluation and review after which it has determined there is a need to update the previously existing Code Section 943.19 to conform to current practices and incorporate the best practice into the Code,

BE IT ORDAINED by the Council of the City of Marion, Marion County Ohio

Section 1.         Marion City Code Section 943.19 “Exemption of Senior Citizens and disabled persons from payment of charges; now reading in part:

§ 943.19 EXEMPTION OF SENIOR CITIZENS AND DISABLED PERSONS FROM PAYMENT OF CHARGES.

       (A)  Citizens of the municipality meeting the following qualifications shall be charged a reduced rate of $16 bimonthly.

       (D)  Subscribers desiring the reduced rate of $16 bimonthly for the sanitation charge shall apply for same at the office of the Sanitation Division. Subscribers shall make application and shall reapply annually by displaying proof of identity and age or disability and by signing an application in the form of an affidavit, swearing to the factual existence of the minimum qualifications as set forth in this section.

SHALL BE AMENDED TO READ AS FOLLOWS:

§ 943.19 EXEMPTION OF SENIOR CITIZENS AND DISABLED PERSONS FROM PAYMENT OF CHARGES.

       (A)  Citizens of the municipality meeting the following qualifications shall be charged a reduced rate of $16 bimonthly 50% OF THE RESIDENT SUBSCRIBER CHARGES AS PROVIDED FOR IN 943.14.

       (D)  Subscribers desiring the reduced rate of $16 bimonthly provided for in 943.19 (A) for the sanitation charge shall apply for same at the office of the Sanitation Division. Subscribers shall make application and shall reapply annually by displaying proof of identity and age or disability and by signing an application in the form of an affidavit, swearing to the factual existence of the minimum qualifications as set forth in this section.

Section 2.       This Ordinance shall take effect and be in force from and after the earliest period allow by law.
