2017-38 S&B for Cheney & Barks Rd Improvements 17-3R

ORDINANCE AUTHORIZING THE PUBLIC WORKS DIRECTOR TO PREPARE SPECIFICATIONS AND RECEIVE BIDS, EXECUTE ALL CONTRACTS AND AGREEMENTS AS NECESSARY, AND APPROPRIATING NECESSARY FUNDS, FOR THE CHENEY AVENUE AND BARKS ROAD IMPROVEMENTS PROJECT 17-3R FOR THE CITY OF MARION, OHIO, AND DECLARING AN EMERGENCY

WHEREAS, Cheney Avenue between Barks Road and Evans Road is in need of substantial repair.

 

WHEREAS, The City of Marion is eligible to receive up to a maximum of $200,000 in funding through the Ohio Development Services Agency Roadwork Development (629) funds and the Ohio Department of Transportation due to the major investment that Nucor Steel is making within the City.

 

BE IT ORDAINED BY the Council of the City of Marion, Marion County, Ohio.

 

Section 1.  That the Public Works Director be authorized to enter in any agreements as necessary to obtain financial assistance and complete the project for the Cheney Avenue and Barks Road Improvements Project 17-3R.

 

Section 2.  That the cost of such contract shall be payable from the SCMR Fund and the Auditor is authorized and directed to appropriate the necessary funds and up to $200,000 shall reimbursed by the 629 and ODOT funds.

 

Section 3.     That this ordinance is hereby declared an emergency measure necessary for meeting the application deadlines; and since Cheney Avenue is in dire need of repair; and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
