2017-21 Beekeeping Chapter 1128 Agricultural Uses

ORDINANCE TO REPEAL CODIFIED ORDINANCE SECTION 618.15 BEE KEEPING IN ITS ENTIRETY AND CREATING NEW CHAPTER 1128 “AGRICULTURAL USES” WITHIN THE ZONING CODE IN THE CITY OF MARION, AS AMENDED

 

 

WHEREAS, the Marion Municipal Code currently prohibits the keeping of bees within the Municipality; and

 

WHEREAS, residents of the City of Marion have requested the Municipal Code be amended to allow for beekeeping within the Municipality; and

 

WHEREAS, it is recommended to repeal Section 618.15 of the Marion Municipal Code and to create a new Chapter 1128 Agricultural Uses within the Zoning Code to allow beekeeping with certain regulations.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MARION, MARION COUNTY, OHIO:

 

Section 1.  Marion Codified Ordinance Section 618.15, Bee Keeping is hereby repealed and replaced with new Chapter 1128 Agricultural Uses, and it to read as follows:

 

Chapter 1128: Agricultural Uses

 

§ 1128.01 Definitions       

 

             Apiarist.   See Beekeeper

 

             Apiary.  The assembly of one or more colonies of bees at a single location.

 

             Apiculture.   The cultivation of bees for purposes of producing honey, pollination services queen breeding programs, or other products of the hive.

 

             Beekeeper.   A person who owns or has charge of one or more colonies of bees.

 

             Beekeeping Equipment.   Anything used in the operation of an apiary, such as give bodies, supers, frames, top and bottom boards and extractors.

 

             Colony.   Colony or hive means an aggregate of bees consisting principally of workers, but having, when perfect, one queen and drones, including brood, combs, honey and the receptacle inhabited by the bees.

 

             Hive.   See Colony.

 

             Honey Bee.   All Stages of the common domestic honey bee.    

 

§ 1128.02 Apiaries.

 

Beekeeping is permitted in all zoning districts subject to the following requirements:

 

 

 

 

Minimum Lot Area and ColonyDensity

 

No Beehive shall be kept on a zoning lot less than 3,000 square feet in area. Additional hives may be added at the rate of one (1) hive for every additional 1,000 square feet of a lot area.

 

Location andSetbacks

 

A.       No beehive shall be placed in a required front-yard or side-yard area.

 

B.       No beehive shall be located closer than 5 feet to any side or rear lot line and 20 feet from a dwelling.

 

Beehive EntranceOrientation

 

The beehive entrance shall be oriented away from adjoining properties (i.e. the entrance shall face the beekeeper’s property).

Shall be placed along the rear and side of the beehive.

Shall be a minimum of 6 feet inheight.
