2016-68 MCC Amending Chapter 109

ORDINANCE AMENDING CHAPTER 109 CONTRACTS AND PURCHASES BY ADDING SECTION 109.03 RENEWAL OF CONTRACTS 

          WHEREAS, City Council has recommended a change in the process of Contract renewals.

          WHEREAS, City Council would prefer that the City Administration do not enter into a contract that gives one party unilateral ability to renew the contract(s) with endless renewals.

          WHEREAS, the Council finds a real and present need to add the existing code in order to serve the people of the City of Marion.

          BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

          Section 1.  Marion City Code Chapter 109 shall be amended to add:

“§ 109.03     Renewal of Contracts.

          The City Council directs Administration that no City contract has an automatic renewal with any vendor having the exclusive right to renew.” 

          Section 2.     It is found and determined that all formal actions of this Council relating to the adoption of this Ordinance were adopted in an open meeting of the Council, and that all deliberations of this Council and of any of its committees that resulted in such formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the ORC.

          Section 3.  This Ordinance shall take effect and be in force from and after the earliest period allowed by law.                                                                       _______________________
