2016-61 Contract for 2015 LODO Infrasturcture Program

ORDINANCE AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO ENTER INTO CONTRACT WITH TELAMON CONSTRUCTION INC. FOR THE 2015 LODO INFRASTRUCTURE PROGRAM AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 2016-14 authorized bidding projects in the FY 2015 CDBG Neighborhood Revitalization Grant (Distress Grant) which includes replacing infrastructure in the LODO neighborhood, and

WHEREAS, after publically advertised solicitation one bid was received in the amount of $314,422, and

WHEREAS, Telamon Construction Inc. was within 10% of the engineer’s estimate, and

WHEREAS, the FY 2015 Allocation and Distress grant has $235,400 collectively budgeted for the sidewalk, street and retaining wall activity, and

WHEREAS, based upon the unit pricing, the contractor and Engineer’s office have mutually agreed upon a reduced scope of work and materials that satisfies the grant objects and fits within the available funds not to exceed 235,400, and

WHEREAS, the contractor could begin in late September 2016, and could complete the project before winter weather arrives by adding the emergency clause to this ordinance.

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1.        That the Director of Public Works be directed to enter into contract with Telamon Construction Inc., 5505 Milan Rd., Sandusky, OH 44870 in the amount not to exceed 235,400 for the LODO Infrastructure Project.

Section 2.        That said contract shall be payable from the Community Development Block Grant FY 2015 Allocation and Distress grants

Section 3.        That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof; and for further reason to have this work completed by year end; and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council: otherwise it shall become effective from and after the earliest period allowed by law.
