NEW BUSINESS:

RESOLUTION 2016-18:

RESOLUTION AUTHORIZING THE CITY AUDITOR TO ADVANCE FUNDS TO THE AIRPORT IMPROVEMENT FUND FROM THE GENERAL FUND FOR THE MARION MUNICIPAL AIRPORT

Mr. Daniels said this came out of Finance with a 2-0 approval. Mayor Schertzer said these documents need to be signed and sent back to the FAA by next week. Mr. Daniels moved to suspend, Mr. Norris 2nd, roll call: Ayes all, motion carried.

ORDINANCE 2016-59:

ORDINANCE AUTHORIZING THE CITY AUDITOR TO APPROPRIATE FUNDS TO AIRPORT IMPROVEMENT FUND AT THE MARION MUNICIPAL AIRPORT and declaring an emergency

          Mr. Daniels said this came out of Finance with a 2-0 approval, I’ll move to suspend, Mr. Huddle 2nd. Roll call: Ayes all, motion carried.

ORDINANCE 2016-60:

ORDINANCE TO VACATE ONE (1) 16’ WIDE EAST/WEST ALLEY LOCATED SOUTH OF 409 BELLEFONTAINE AVE (BETWEEN LOT NUMBERS 5902 AND 5987) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Marion Pointe)

          Mr. Thomas noted that this came out of Streets & Sewers with a 3-0 recommendation for approval, I’ll ask for a 1st reading tonight. We will have a public hearing on Sept. 26, 2016 with its 3rd reading.  ORDINANCE 2016-60 HAS HAD IT’S FIRST READING

ORDINANCE 2016-61:

ORDINANCE AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO ENTER INTO CONTRACT WITH TELAMON CONSTRUCTION INC. FOR THE 2015 LODO INFRASTRUCTURE PROGRAM AND DECLARING AN EMERGENCY

          Mr. Ratliff said this came out of Committee with a 3-0 to pass onto Council. There was some more work that needed to be done. The number came in to high. We pared some things down, but still have the meat of the contract intact. We are still over 17,000. I’ll ask for a 1st reading tonight.

          Mayor Schertzer said I want to thank Ms. Cummings, she has worked very hard to bring these monies down, we started off at a budget of 79,000 over. I want Council to understand how hard she has worked on this for bringing it down close to budget.

          Ms. Cummings said we have touched based with the property owners. The contractor met me out in the field with the property owners, and everybody is getting comfortable with the procedures and the projects. I’m appreciative with the neighbors and property owners as well.  ORDINANCE 2016-61 HAS RECEIVED ITS 1ST READING

ORDINANCE 2016-62:

ORDINANCE MAKING AN ADDITIONAL APPROPRIATION IN THE POLICE LAW ENFORCEMENT TRUST FUND FOR THE YEAR ENDING DECEMBER 31, 2016 THE SOURCE OF FUNDS BEING COMMUNITY DONATIONS AND CCW CLASS FEES

          Mr. Daniels said this came out of Finance with a 2-0 recommendation for approval, I’d like to suspend, Ms. Cunningham 2nd. Roll call: Ayes all, motion carried.

ORDINANCE 2016-63:

ORDINANCE AUTHORIZING AND DIRECTING THE PUBLIC WORKS DIRECTOR TO ENTER INTO CONTRACT WITH UNDERGROUND UTILITIES, INC. FOR THE BELMONT STREET SEWER IMPROVEMENTS PROJECT 16-3S FOR THE CITY OF MARION, OHIO, APPROPRIATING NECESSARY FUNDS, AND DECLARING AN EMERGENCY

ORDINANCE 2016-64:

ORDINANCE TO AMEND THE YARGER REPORT BY CREATING A POSITION WITHIN THE MUNICIPAL COURT, SPECIFICALLY A SPECIAL DOCKETS COORDINATOR POSITION, ESTABLISHING SALARY AND BENEFITS FOR SAID POSITION AND DECLARING AN EMERGENCY

          Mr. Thomas said this came out of Municipal Services with a 2-0 recommendation for approval, I’ll ask for a 1st reading tonight. Mr. Ratliff said in Section 2, the first sentence, motion to amend Section 2 where it says Grant Specialist is should read “Special Dockets Coordinator”, Ms. Cunningham 2nd.  Roll call: Ayes all, motion carried. ORDINANCE 2016-64 HAS BEEN AMENDED AND HAS HAD IT’S 1ST READING.

ORDINANCE 2016-65:

ORDINANCE AUTHORIZING THE ADMINISTRATION TO ACCEPT A CAPITAL IMPROVEMENT COMMUNITY RECREATION PROJECTS GRANT WITH OHIO DEPARTMENT OF NATURAL RESOURCES, and declaring an emergency

Mr. Daniels said this came out of Finance with a 2-0 approval. He asked if there is any urgency. Mayor Schertzer said this is a grant with a State Agency. Mike Cheney said there is no deadline with the DNR, but there is a multi-step process. Mayor Schertzer said it’s a grant from the State to fix the baseball complex. Mr. Daniels moved to suspend, Mr. Thomas 2nd. Roll call: Ayes all, motion carried.

            Mr. Huddle asked if this is a onetime grant. Mr. Cheney said yes. Mr. Huddle asked where is the money going to. Mr. Cheney said it will be an early phase – removing some top soil from the outfield, drainage issues, the very first things to be done. Mr. Huddle said your operating cost out there? Who operates it? Mayor Schertzer said it’s the Marion Merchants. Mr. Huddle said Tournaments, donations, Bingo is where they get their monies. Mayor said yes, we don’t use city tax dollars to run the organization. Phil Reid did some research on it – on no time the Municipal Government was never responsible for the baseball. This grant came out of with State Senator Dave Burke. I worked with Dave Burke, Mike wrote up a letter back in March. That’s what let us to getting this grant, along with the final paper work that Mike is working on now. Mr. Huddle asked if you had to give them an estimate. Mr. Cheney said it’s a complete renovation of field and stadium with a projected price. Mayor Schertzer said I would see this as the City’s in-kind contribution to the Park.

Mrs. Gustin asked about the historical renovation. Mayor Schertzer said when you go after historical monies, the price tag changes dramatically. Restore the Glory has shied away – they may still be looking at those as a possibility. When you add in ADA compliance, electrical laws, that’s where the price tag goes up.

Items not on the Agenda: 

Mr. Ratliff asked about the overpass and street projects and the Popcorn Festival time frame? Mayor Schertzer said the Director of Public Works will answer.  Jim has been attending ODOT meetings. Jim Bischoff said it will be open for the Popcorn Festival. They have 3 piers (the big columns) left to do. The need a railroad flagger, they were supposed to be there last Monday, they didn’t show up today. They have around 2 weeks work left.

            Mr. Ratliff asked what was wrong. Jim said there were 8 bridges in Franklin, Delaware and Marion. They were to remove concrete and replace it. They found some unsound concrete deeper in the area. That was their concern. They thought it was best to get the traffic off, so as they can work underneath it.

            Mayor Schertzer wants to let Council know that this Sat. is Restoration Weekend. We certainty appreciate the churches coming together and doing these projects. 2 weeks before the popcorn Festival they come down and do a good clean up.

            Ms. Blevins asked Jim how do you know for sure that it will be done before the Popcorn Festival. Jim said we stressed the importance of having is done before the Festival.

            Mr. Robbins said that he got a couple of complaints in the office. The RR is working on the tracks at Bellefontaine Ave. Some companies have stressed their displeasure of them being there. It is a RR project, we have no control over them and the time line. It is frustrating a lot of people over there on the West side. We have no influence over the RR. Mayor Schertzer said they extended all this week, we often don’t get these notifications weeks in advance. Gary Barber was concerned about bussing at the Marion City Schools. We could call the RR, but I don’t think they will work any faster.
