ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO APPLY FOR FAA FY 2016 GRANT FUNDS AND OHIO DEPARTMENT OF TRANSPORTATION GRANT FUNDS, ADVERTISE FOR BIDS AND ENTER INTO CONTRACT FOR CRACK SEALING, JOINT REPAIR OF RUNWAY 13/31, TAXIWAYS, AND TERMINAL BUILDING DESIGN ON PROJECT #24 AT THE MARION MUNICIPAL AIRPORT AND DECLARING AN EMERGENCY

 

            WHEREAS, The City of Marion has been tentatively allocated $ 227,000.00 FAA Grant AIP 3-39-0050-2416, known as Project #24,

 

            WHEREAS, 90% or $204,300.00 grant funds are available through Federal Aviation Administration, 5% or $11,350.00 available through Ohio Department of Transportation and 5% or $11,350.00 available through City of Marion and the City Council supports the application for any such grant funds. Total cost for Project # 24 is $227,000.00

 

            WHEREAS, the grant application and final grant award is offered as a result of these bids.

 

            BE IT ORDAINED by the Council of the City of Marion, Marion, County, Ohio:

 

            Section 1.         That the Safety Director is hereby authorized and directed to advertise for bids for crack sealing and joint repair of Runway 13/31, Taxiways Alpha, Bravo, Charlie, Delta, Echo, Foxtrot and Gulf at the Marion Municipal Airport. In the event the bids received are less than the total estimate of the consultant and the funds are available, the Safety Director is hereby authorized to enter into contract with the lowest and best bidder.

 

            Section 2.         That the Safety Director is hereby authorized to apply for FAA FY 2016 and, Ohio Department of Transportation FY 2016 Project #24 Grants.

 

            Section 3.         The specifications were prepared by GA Consultants of Maumee, Ohio, who was selected per FAA guidelines and authorized by Ordinance 2014-13.

 

           Section 4.    That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

 

           Section 5.    That this resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, welfare and safety of the City of Marion and the inhabitants thereof; and due to fact that this Grant must be received by May, 2016, and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
