ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF MARION, BY REZONING 225 EAST BARKS ROAD FROM AN R-1A (SINGLE FAMILY DISTRICT, LOW DENSITY) TO C-2 (COMMUNITY SHOPPING DISTRICT), AND DECLARING AN EMERGENCY, as amended (Applicant, the Kroger Company)

 

 

          WHEREAS, Council finds that the real property described below, should be rezoned, from an R-1A (Single Family District, Low Density) to an C-2 (Community Shopping District), and

 

WHEREAS, Marion City Planning has recommended this change by a 6-0 vote at its meeting on February, 2, 2016 and

 

          WHEREAS, due notice of the hearing on said rezoning has been given by publication in accordance with law,

 

          BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 

          SECTION 1.  That the property known as 255 East Barks Road, Marion, Ohio and being more particularly described in the attached Exhibit A.  Said parcel currently zoned as an R-1A (Single Family District, Low Density) will be changed to an C-2(Community Shopping District), and

 

          SECTION 2.  That the Clerk of Council is hereby authorized and directed to make said change on the Zoning District Map of the City of Marion on file in the office of the Clerk of Marion City Council and on the copy thereof on file in the office of the Service Director.

 

SECTION 3.  This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare, and safety of the City of Marion and the inhabitants thereof and for the further reason that we expedite the rezoning of this parcel in order for Kroger to build a new store; and as such, shall take effect immediately upon its passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
