ORDINANCE AMENDING ORDINANCE 2007-107 REGARDING THE RESIDENCY REQUIREMENT (SECTION 5) FOR THE SAFETY DIRECTOR POSITION, AMENDING THE YARGER REPORT AND DECLARING AN EMERGENCY, AS AMENDED

 

Whereas, Ordinance 2007-107 amended a prior Ordinance which modified the Administration's ability as to the pool of available persons to serve in the capacity as Safety Director, more specifically found in Section 5 the aforementioned Ordinance, and

 

            Whereas, Council the Administration has indicted it finds it necessary to request the requirement be further modified as set forth below,

 

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 

            Section 1.    Council finds it in the best interest of the citizens of Marion to further modify remove a provision requiring residency as to the Safety Director.

 

Section 5 in Ordinances 2007-107 now reading as:         

 

            “Section 5. Pursuant to authority granted under 737.01, the Council hereby waives the residency requirement contained therein. Said provision having been waived, Council determines the Director shall reside within the County of Marion, Ohio.”

 

Shall be amended to read as follows:

 

“Section 5. Pursuant to authority granted under 737.01, the Council hereby waives the residency requirement contained therein. Said provision having been waived, Council determines the Director shall reside within the County of Marion, Ohio or an adjacent County as provided in Revised Code 9.481(B)(2)(b).”

 

            Section 2.       That this Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof; given the immediate need to implement the change of residency for the Safety Director to include adjacent outlaying counties residency; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all member elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
