ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF MARION, BY REZONING THE FORMER CATHOLIC HIGH SCHOOL AT 1001 MT. VERNON AVE FROM AN R-1A (SINGLE FAMILY DISTRICT, LOW DENSITY) TO R-2 (GENERAL DISTRICT), as amended (Applicant, the Woda Group/St. Mary Church)

 

            WHEREAS, Council finds that the real property described below, should be rezoned, from an R-1A (Single Family District, Low Density) to an R-2 (General Dwelling District), and

 

WHEREAS, Marion City Planning has recommended this change by a 3-2 vote at its meeting on January 19, 2016, and

 

            WHEREAS, due notice of the hearing on said rezoning has been given by publication in accordance with law,

 

            BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 

DEED RESTRICTION

 

In order to give developers some flexibility in developing the site for senior housing or similar uses, but eliminate other more commercial uses that could be detrimental to the area, including single family homes and apartments adjacent,  this site shall be treated as a planned development project (Chapter 1147).

The City and the developers shall jointly create a legal document that specifies which uses are allowed or not allowed.  The City will then have the power to legally enforce this agreement. 

 

USES ALLOWED:

Any use currently or, in the future, allowed in the R-1A Single Family Zoning District, with densities and development standards as regulated in that district.  For example, Single family dwellings, Public and parochial schools, and churches as regulated in the R-1A District.
Multi-family dwellings for Senior Citizens, Town houses for Senior Citizens, Nursery schools and day nurseries, convalescent homes and/or rest homes for the aged, and offices of civic, religious, and charitable organizations.  All of these shall be permitted and regulated as allowed in the R-2 General Dwelling District.

USES PROHIBITED:

R-2 PRINCIPAL PERMITTED USES not listed above under ‘’USES ALLOWED.”
R-2 CONDITIONAL PERMITTED USES

            SECTION 1.  That the property known as 1001 Mt. Vernon Ave., also known as the form Marion Catholic High School, Marion, Ohio and being more particularly described in the attached Exhibit A.  Said parcel currently zoned as an R-1A (Single Family District, Low Density) changed to an R-2 (General Dwelling District), with the above deed restrictions being filed and the continuing obligation, and

          

            SECTION 2.  That the Clerk of Council is hereby authorized and directed to make said change on the Zoning District Map of the City of Marion on file in the office of the Clerk of Marion City Council and on the copy thereof on file in the office of the Service Director.

 

SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
