ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO EXERCISE THE EXISTING RENEWAL PROVISION IN THE AGREEMENT WITH MARION COUNTY FOR INDIGENT PERSONS CHARGED IN THE MARION MUNICIPAL COURT, AND DECLARING AN EMERGENCY

        WHEREAS, the Council did by previous Ordinance 2015-51 authorize the Safety Director to enter into contract with the County Commissioners to reimburse the county for counsel appointed to represent indigent persons charged with the violations of the ordinances of the municipal corporation, and

          WHEREAS, the Council wishes to permit the Safety Director to exercise the provision for a second year period with the County Commissioners,

 

          BE IT ORDAINED by the Council for the City of Marion, Ohio:

 

Section 1.     The Safety Director of the City of Marion, Ohio is hereby authorized to exercise and take all actions necessary to exercise the second year of the contract according to its previously adopted terms with Marion County for counsel appointed to represent indigent persons charged with violations of the ordinances of the municipal corporation.

        

Section 2.     This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof:   Due to the real and present need to move forward without delay given the contract with the County will expire the first of the year; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
