City Hall – Council Chambers on October 26, 2015, 7:30 PM

 

ROLL CALL - 9 members answered – Mr. Ratliff, Mr. Thomas, Mrs. Blevins, Mr. Smith, Mr. Osborn, Mr. Crider, Mr. Daniels, Mrs. Gustin, Mr. Edwards. Mr. Ratliff moved to excuse Mr. Osborn, Mr. Thomas 2nd. Roll call: Ayes all, motion carried, Mr. Cumston is excused.

PLEDGE OF ALLEGIANCE

 

Summary of Proceedings from October 12, 2015. Mr. Thomas moved, Mr. Osborn 2nd. Mr. Crider noted an error on 2015-80 should say 2nd reading rather than the 1st reading. Clerk changed it. Roll Call: Ayes all, motion carried, Summary of Proceedings is accepted.

 

OLD BUSINESS:

 

ORDINANCE 2015-79:

ORDINANCE AMENDING SECTION 1151.065 USES AND PROJECTIONS PERMITTED IN YARDS OF THE PLANNING AND ZONING CODE AS CONTAINED WITHIN THE MARION CITY CODE

          Mr. Daniels said this came out of Legislation Codes with a 3-0 recommendation for approval, I move to suspend the rules, Mr. Thomas 2nd.  Roll call: Ayes all, motion carried. ORDINANCE 2015-79 IS ADOPTED.

       

ORDINANCE 2015-80:

ORDINANCE TO VACATE ONE (1) 12’ WIDE EAST/WEST ALLEY LOCATED NORTH OF 437 WINDSOR ST., (BETWEEN LOT NUMBERS 2568 AND 2569) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Greg Darling)

          Mr. Thomas said this came out of Streets & Sewers with a 0-3 NOT to approve the vacation of the alley. I’ll ask for a public reading tonight.

 

PUBLIC HEARING OPENED 7:35 P.M.

          Mr. Thomas said this was in City Planning also, it affects the whole neighborhood to close this. Mr. Lengieza said it came a tie out of City Planning. The people that use the N/S alley, they would have circle around the block, there were good reasons to vacate it, but those people would have been impacted.

          Mr. Clayton Young, 231 W. Pleasant St. spoke: This would be a great inconvenience to me. I have a building over in that area at least 2X a day. I do oppose the closing of the alley. Mr. Jones opposes, Mr. and Mrs. Hughes are opposed as well. Mr. Sulu Kelley spoke about this alley; I oppose it, since I do use it.

          Mr. Greg Darling 437 Windsor St. spoke: The traffic going through the alley thinks it’s their own personal raceway. The drub traffic has gotten out of hand, picking up needles. Garbage pickup daily; at least a bag a day dropped off.

 

Mrs. Gustin asked to hear from Chief Zwolle. Chief mentioned that the Fire Dept has not been a advocate of closing alleys, we use them.

 

PUBLIC HEARING CLOSED 7:44 P.M.

       

          Mr. Thomas moved to approve and encourage Council to vote NO, Mrs. Blevins 2nd. Roll call: NAYS all, motion carried. ORDINANCE 2015-80 IS DEFEATED

       

NEW BUSINESS:

 

Judge Ballinger spoke on the 3 court dockets that are offered within the Municipal Court System.

 

1. Medication Assisted Recovery Court

2. Special Docket on Mental Health

3. Veteran’s Court

 

Matters not on the Agenda:

 

Mr. Osborn asked about the document from the City Auditor. Who is the independent Auditor that prepared this, and how much did it cost us. Mrs. Carr said that is provided by LGS by the State Auditor Office. The price is about 65-75/year every year.

 

Mr. Jerry Brown on 427 Clinton St. spoke about his neighbor, fences, and gutters.

 

Ms. Christina Spoffard spoke on the pink notices that City puts out concerning the trash. The charge of $50.00 and a one day notice. You should make it a 3 day notice and tone down the language on the signs.

 

Mr. Tim Peacock spoke: Representing Peacock Water and I’m on the DT Board. I want to thank you for working with the DT involvement. The community is looking good – it’s a good appeal, I want to thank the City.
