ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO FINALIZE THE AGREEMENT FOR ENGINEERING DESIGN SERVICES TO MEET THE DEADLINE UNDER ODOT’S LARGE CITY FUND PROGRAM TO FACILITATE THE REPAVING OF WEST CENTER ST. AND DECLARING AN EMERGENCY

WHEREAS, the City of Marion participates in ODOT’S Large City Fund program with an annual allocation of about $538,000 of which eligible projects must be programmed in advance in order to avoid losing funds, and

 

WHEREAS, City of Marion borrowed ahead to complete $1,783,000 resurfacing projects but is now due a partial allocation which must be expended for needed transportation projects, and

 

WHEREAS, the City of Marion prioritized West Center Street as an eligible paving project of which construction will be 80% paid from the Large City Fund program with a 20% local match, and

 

WHEREAS, the Administration conducted an engineering services request for proposal process to meet ODOT’s time frame to find the best technical service provider for repaving West Center Street from Whirlpool on the west to Davids Street on the east within the City of Marion, and

 

WHEREAS, the City of Marion will pay for such engineering services to comply with the ODOT project schedule and facilitate construction in ODOT FY 2017, and

 

WHEREAS, the Administration is in receipt of an engineering services contract as received on September 29, 2015 from EMH&T in the amount of $42,840, and

 

BE IT ORDAINED by the Council of the City of Marion, Ohio: Marion County,

 

Section 1.       The Service Director is authorized to execute the engineering services contract with EMH&T in the amount of $42,840 payable from the SCMR Fund to set the stage for paving sections of West Center Street from Whirlpool on the west to Davids Street on the east in the City of Marion. The Council finding the endeavor to be a desired and beneficial undertaking it does hereby authorize the Service Director or his designee(s) complete all necessary steps, agreements, processes, processes and items related to the repaving of West Center St. from Whirlpool to Davids St. during ODOT FY 2017

 

Section 2.       Such construction project shall be payable 80% from the ODOT’s Large City Funds program, with a 20% local match.

 

Section 3:       That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof; and since the City needs to meet and comply with ODOT’s deadlines; and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council: otherwise it shall become effective from and after the earliest period allowed by law.
