NEW BUSINESS:

 

RESOLUTION 2015-19:

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR FY 2016 GRANTS, THROUGH THE US DOT FEDERAL TRANSIT ADMINISTRATION, AS AUTHORIZED UNDER FEDERAL TRANSIT LAWS, AS CODIFIED, 49 USC SECTION 5311, FINANCIAL ASSISTANCE FOR OTHER THAN URBANIZED AREAS AND FUNDS AVAILABLE FROM THE OHIO PUBLIC TRANSPORTATION GRANT PROGRAM AND OHIO ELDERLY AND DISABLED TRANSIT FARE ASSISTANCE PROGRAM AND EXECUTING A CONTRACT WITH THE OHIO DEPARTMENT OF TRANSPORTATION UPON GRANT APPLICATION APPROVAL, AND DECLARING AN EMERGENCY

            Mr. Cumston stated that this came out of Finance with a 3-0 approval, this is for the 2016 grant for the Transit Dept as well as obtaining new buses, I’ll make the motion to suspend, Mr. Smith 2nd. Roll call: Ayes all, motion carried.

Mrs. Gustin inquired why so quickly, Mr. Cumston said that they have a deadline to meet with ODOT. Mayor Schertzer said it’s not unusual with working with ODOT, they want the ER clause on their legislation.

            Mr. Cumston moved to adopt, Mr. Smith 2nd. Roll call: Ayes all, motion carried. RESOLUTION 2015-19 IS ADOPTED

 

ORDINANCE 2015-78:

ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR COMPLETE AN RFP AS TO THE CITY’S NEED TO HAVE A TRAFFIC CONTROL SIGN EVALUATION COMPLETED AND DECLARING AN EMERGENCY

            Mr. Cumston said this came out of Municipal Services with a 2-0 recommendation for approval, this is for a RFP – request for proposals – to evaluate all signs with the City of Marion, it will give us a complete inventory and let us know what to add or take down. I move to suspend, Mr. Smith 2nd; Roll call: Ayes all, motion carried.

            Mr. Ratliff asked how often is this done. Mr. Russell said as far as he knows of all the years he’s been in office, it was never done. Mr. Ratliff asked if this is just the signs, Mr. Russell said not the traffic signals, stop signs, one-way signs, right-of-way signs, etc. Mr. Osborn said he thinks it’s a wonderful idea –it’s a good study. Mayor Schertzer said we have never had a comprehensive study of this magnitude done before. Mrs. Blevins asked about the unwarranted stop signs – will the City take them down. Mr. Russell said you’re getting ahead of yourself. It will include street by street signage only, not the lights. Mr. Shoup said that study has been done, phase 5 is completed. Mr. Daniels mentioned about reducing the City’s liability by identifying the signage issues.

 

            Mr. Cumston moved to adopt, Mr. Crider 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2015-78 IS ADOPTED

 

ORDINANCE 2015-79:

ORDINANCE AMENDING SECTION 1151.065 USES AND PROJECTIONS PERMITTED IN YARDS OF THE PLANNING AND ZONING CODE AS CONTAINED WITHIN THE MARION CITY CODE

            Mr. Daniels said this came out of Legislation Codes with a 3-0 recommendation for approval, this is concerning the placement of fences, putting the attractive side facing the neighbors.

            Mr. Lengieza spoke: this will come before City Planning on Tuesday, Oct. 6.

            Mr. Daniels said he’d like a first reading tonight. ORDINANCE 2015-79 HAS HAD ITS FIRST READING

 

ORDINANCE 2015-80:

ORDINANCE TO VACATE ONE (1) 12’ WIDE EAST/WEST ALLEY LOCATED NORTH OF 437 WINDSOR ST., (BETWEEN LOT NUMBERS 2568 AND 2569) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Greg Darling)

            Mr. Thomas said this came out of Streets & Sewers with a 0-3 NOT to approve the vacation of the alley. I’ll ask for a 1st reading tonight.

            Mr. Clayton Young, 459 Windsor spoke – he is not in favor of this vacation of the alley. He also spoke for Mr. Jones and Mr. Hughes. Mr. Thomas asked Clerk to get the minutes to all of Council. ORDINANCE 2015-80 HAS HAD ITS FIRST READING

ORDINANCE 2015-81:

ORDINANCE AUTHORIZING THE MAYOR TO COMPLETE ALL AGREEMENTS NECESSARY TO ALLOW THE USE OF URBAN DEVELOPMENT PROGRAM INCOME FUNDS UP TO A SUM CERTAIN FOR DEMOLITION AND SITE WORK IN DOWNTOWN MARION AS A PART OF A CO-OPERATIVE EFFORT RELATED TO A SPECIFIC REVITALIZATION PROJECT, APPROPRIATING THE NECESSARY FUNDS AND DECLARING AN EMERGENCY

            Mr. Cumston stated that this came out of Finance with a 3-0 recommendation for approval; I move to suspend, Mr. Thomas 2nd. Roll call: Ayes all, motion carried.

            Mr. Cumston moved to adopt, Mr. Thomas 2nd. Mr. Osborn mentioned that he spoke with the Law Director before the meeting concerning the ownership of this land; I feel comfortable with his comment.

            Roll call for adoption: Ayes all, motion carried. ORDINANCE 2015-81 IS ADOPTED

 

Matters not on the Agenda:

            Law Director Russell spoke on the upcoming Land Bank Sale which will be held at City Hall lobby on October 20th @ 10:30 a.m.

            Dan Deville of First Energy spoke about fraud –people coming to your houses and claiming they are from the Electric Company.

            Vanessa Sweet spoke on the Liquor Permit that was not approved via City Council.

            Lois Fisher thanked the City Council for passing the ordinance for the DT Grants.
