ORDINANCE AUTHORIZING THE MAYOR TO COMPLETE ALL AGREEMENTS NECESSARY TO ALLOW THE USE OF URBAN DEVELOPMENT PROGRAM INCOME FUNDS UP TO A SUM CERTAIN FOR DEMOLITION AND SITE WORK IN DOWNTOWN MARION AS A PART OF A CO-OPERATIVE EFFORT RELATED TO A SPECIFIC REVITALIZATION PROJECT, APPROPRIATING THE NECESSARY FUNDS AND DECLARING AN EMERGENCY

 

WHEREAS, The City Administration has been actively pursuing all means to address the burnt out structures located on 146-148 S. Main St within the City's Downtown Business District which have been determined to be a nuisance and safety hazard in need of remediation, and

 

WHEREAS, City Administrators and City Planning staff working with Downtown Marion Inc. did apply for a supporting grant from the Marion Community Foundation for assistance in revitalization project which could also include a neighboring building, if certain conditions are met, and

 

WHEREAS, The City Administrators and the Downtown Marion Inc. group have received an indication the Foundation is interested in partnering with certain conditions in place to assure  demolition, site vitalization and community re-development for a public purpose and the request herein is portion of the funding package, and

 

WHEREAS, the Office of the Law Director did obtain the statutory monetary amount from the two building owners and is pursuing additional amounts from the responsible parties by having filed the necessary pleadings and charges in the Common Pleas Court and Marion Municipal Court, and

 

WHEREAS, the northern most nuisance structure utilized grant funds in the past and by contract was obligated to maintain sufficient insurance, however the owner failed to do so.  And, the demolition would have been complete if not for the determination made by the State of Ohio EPA that certain processes must be utilized given the asbestos present in the building roof caulk which is present in all roof caulk,

 

BE IT ORDAINED, by the Council of the City of Marion, Marion County, Ohio:

 

Section 1.         The Council authorizes the use of up to $30,000 from Urban Development program income funds which are authorized to be appropriated into line item Demolition 241.2049.5459 and the Mayor is authorized to enter any agreement he determines appropriate in order to complete the demolition, remediation and revitalization of the properties at 146, 148 S. Main St. and the adjoining property to the south.

 

Section 2.         That this Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof and for the further reason that the site is a blight on Downtown Marion and that other entities need to know the City’s Commitment , and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
