ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH UTILITY TRUCK EQUIPMENT, INC. FOR THE PURCHASE OF ONE (1) 40’ AERIAL BUCKET TRUCK FOR THE STREETS DEPARTMENT AND DECLARING AN EMERGENCY

          WHEREAS, Council has the understanding that the Streets Department is in dire need of a new Bucket Truck; and

 

          WHEREAS, under ORC 9.48 (Joint purchasing programs), a political subdivision can participate in a joint purchasing program operated by or through a national or state association of political subdivision in which the purchasing political subdivision is eligible for membership; and

 

          BE IT ORDAINED by the Council of the City of Marion, Ohio: Marion County,

 

          Section 1.  That the Service Director is hereby authorized and is hereby directed to enter into contract with Utility Truck Equipment, Inc. (an ODOT low bid supplier) for the purchase of a new 40’ Aerial Bucket Truck for use in the Streets Department. The cost is $109,590.00 funded from the SCMR Fund 202.2006.5304.

 

          Section 2.     That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof; and since that there is a nine (9) month build-out for such vehicle; and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
