PICK–UP RESOLUTION

EXISTING PICK–UP PLAN

RESTATED RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARION OHIO AND DECLARING AN EMERGENCY

The City Council of City of Marion, Marion County, Ohio met at a duly called and authorized meeting of the City Council on the date set forth below, such meeting being duly called pursuant to a notice stating the time, place and purpose of the meeting received by all Council members, and the following resolutions were made, seconded, and adopted by those present at the meeting.

 

 

WHEREAS, the Non-bargaining Employees of the City of Marion participate in the Ohio Public Employees Retirement

 

 

WHEREAS, the City Council has previously adopted a pick–up of 6% of the ten percent (10%) mandatory contributions pursuant to IRC Section 414(h)(2) for the Non-bargaining Employees who are members of the Ohio Public Employees Retirement.

 

WHEREAS, the City Council wishes to reaffirm, amend and/or restate its prior resolution in order to continue the pick–up under new procedures;

 

 

NOW, THEREFORE, BE IT RESOLVED, that effective as of April 5, 2015 for bi-weekly employees and effective April 16, 2015 for semi-monthly employees, the Marion City Council has determined to pick–up 0% of the statutorily required contributions to OPERS for those who are members of the Ohio Public Employees Retirement. The remaining percentage is to be paid by the employees as taxed contributions.

Section 1.  That this resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of said City and for the further reason that it is necessary for the daily operation of the City; and for further reason that this legislation needs to be sent back to the Pension Board as soon as possible;  and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
