MARION CITY COUNCIL MEETING

City Hall – Council Chambers on June 9, 2014, 7:30 PM

 

ROLL CALL – 8 members answered - Mr. Cumston, Mr. Ratliff, Mr. Thomas, Mrs. Blevins, Mr. Smith, Mr. Osborn, Mr. Crider, Mr. Daniels; Mr. Cumston moved to excuse Mrs. Gustin and Mr. Edwards, Mr. Ratliff 2nd. By a voice voce all members voted to excuse both Mrs. Gustin and Mr. Edwards.

PLEDGE OF ALLEGIANCE

 

Summary of Proceedings for May 27, 2014, Mr. Cumston moved, Mr. Smith 2nd. Roll call: Ayes All, motion carried. Summary is approved.

 

 

 

            Roxanne Somerlot and Ron Meade from Jobs and Family Services are here to speak on the imminent closure of ConAgra Foods. We are focused on the re-employment of the ConAgra workforce. We enact a program we call Rapid Response. We connect with that employer and pull together a response team.

 

            Mr. Ron Meade spoke: We are going to meet with them this week; we wish to transition them in comparable jobs. We are going to give surveys to every employee. Put them under one roof. Give them information that they need. We will set up a position on site @ ConAgra. Hire Fair on September 25, we are also thinking about doing another just for ConAgra. They have a great workforce out there, 5 years plus, we want to help them transition as easier as possible.

 

            Mr. Daniels mentioned something about an employer looking for 250 people, THE REST WAS INAUDIBLE.

 

            Mayor Schertzer mentioned that I did get a call from the plant manager and had a meeting with local officials that day. That was the topic of discussion in that meeting. It was a good group that came together. I thought it was important that we share this information with Council. He will be going to the Commissioners tomorrow to speak on this. The Community leadership did come together to address this issue.

 

Mr. Thomas thanked everyone for the information on ConAgra.

 

 

 

OLD BUSINESS:

 

 

 

ORDINANCE 2014-33:

 

ORDINANCE TO VACATE TWO (2) 16.5’ WIDE EAST/WEST ALLEYS SECTIONS LOCATED BETWEEN PEARL STREET AND SOUTH PROSPECT STREET, (SECTIONS LOCATED BETWEEN LOTS 290, 291, 119 AND 143) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Emanuel Lutheran Church)

 

          Mr. Crider noted that this came out of Streets & Sewers with a 2-0 recommendation for approval, we are asking for a 2nd reading tonight with a public hearing on June 23rd. LEGISLATION HAS HAD ITS SECOND READING

 

 

 

NEW BUSINESS:

 

 

 

RESOLUTION 2014-15:

 

RESOLUTION APPROVING AND ADOPTING THE BUDGET OF THE CITY OF MARION, OHIO FOR THE YEAR 2015, AND DECLARING AN EMERGENCY

 

          Mr. Cumston stated that this came out of Finance with a 2-0 recommendation for approval. This is the annual prelim budget that is sent to County for approval; I move to suspend, Mr. Osborn 2nd. Roll call: Ayes all, motion carried.

 

          Mr. Cumston moved to adopt, Mr. Osborn 2nd. Roll call: Ayes all, motion carried. RESOLUTION 2014-15 IS ADOPTED

 

 

 

ORDINANCE 2014-37:

 

ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH PARK ENTERPRISE CONSTRUCTION CO., INC. FOR THE NORTH GREENWOOD STREET SEWER IMPROVEMENTS PROJECT 13-1S, AND DECLARING AN EMERGENCY

 

          Mr. Crider stated said that this passed with a 3-0 recommendation; I’ll have Engineer Lively speak.

 

          Eng. Lively spoke: we are trying to get the issue with Helms resolved, to take care of the problem over on Milburn St. The Law Director directed an agreement and asked input from staff, and got it to Helms about Noon on Friday; they have some questions regarding that agreement. They would like to have some time for them to go over these problems. I’m asking tonight for a 1st reading on this, and give us some time to get those questions answered. Mr. Thomas said we have enough time to do that in line with the Grant money. Mr. Lively said every day that we wait, is at the end of the summer we wish we had. I haven’t heard anything from OPWC. I think if we get this resolved in the next several days, we’ll be OK.

 

          Mayor Schertzer asked council for a special meeting next Tuesday night after committee to dispense with just this issue. Mr. Thomas said asked Mr. Helms is that going to fit in your schedule, that we have all the information, by next Monday night. Mr. Shane Helms said that we have been working on the issues since Friday afternoon. Worked Friday, Sat. There are some issues that I feel that are not in my job, I’ll have to ask Terry on these.

 

          Mr. Crider asked for a 1st reading tonight. ORDINANCE 2014-37 HAS HAD ITS FIRST READING

 

 

 

ORDINANCE 2014-38:

 

ORDINANCE APPROVING THE PARTICIPATION TO PURCHASE ONE (1) EMERGENCY MEDICAL VEHICLE FOR THE MARION FIRE DEPARTMENT THROUGH THE OHIO COOPERATIVE PURCHASING PROGRAM AND DECLARING AN EMERGENCY

 

          Mr. Cumston stated that this came out of Finance with a 2-0 recommendation for approval, motion to suspend, Mr. Smith 2nd. Roll call: Ayes all, motion carried.

 

          Mr. Cumston moved to adopt, Mrs. Blevins 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2014-38 IS ADOPTED

 

 

 

          Mr. Ratliff asked to add Ordinances 2014-39 and 2014-40 on tonight’s agenda, Mr. Smith 2nd, Mrs. Blevins 3rd. ORDINANCES 2014-39 and 2014-40 are added to the agenda.

 

 

 

ORDINANCE 2014-39

 

ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ADVERTISE FOR BIDS AND ENTER INTO CONTRACT FOR THE LEASE OF CERTAIN FARM LANDS ADJACENT TO THE MARION MUNICIPAL AIRPORT

 

          Mr. Ratliff stated that this came out of Committee with a 3-0 recommendation, this is land that has been leased out for 40+ years, there is an additional of 5 year extension, the expiration date for the lease is in September, I’d like to make the motion to suspend, Mr. Smith 2nd. Roll call: Ayes all, motion carried.

 

          Mr. Ratliff moved to adopt, Mr. Smith 2nd. Roll Call: Ayes all, motion carried. ORDINANCE 2014-39 IS ADOPTED

 

 

 

ORDINANCE 2014-40

 

ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO APPLY FOR FAA GRANT FUNDS, ADVERTISE FOR BIDS AND ENTER INTO CONTRACT FOR CONSTRUCTION ON FAA GRANT AIP 3-39-0050-2214 AT THE MARION MUNICIPAL AIRPORT AND DECLARING AN EMERGENCY

 

Mr. Ratliff stated that this came out of Committee with a 3-0 recommendation, this is a grant that has changed in the recent days; there is a submission of 7-7-14 to get this in to advertise for bids, so I’d like to make the motion to suspend, Mr. Smith 2nd. Roll call: Ayes all, motion carried.

Mr. Osborn stated that we’d act on a special council meeting on the 17th to address Ordinance 2014-37 @ 6:45; 2nd by Mr. Smith. Roll Call: Ayes: Mr. Cumston, Mr. Ratliff, Mrs. Blevins, Mr. Smith, Mr. Osborn, Mr. Crider; Abstain: Mr. Daniels.  SPECIAL COUNCIL MEETING SLATED FOR 6-17-14 @ 6:45 PM TO ADDRESS ORDINANCE 2014-37.

 

 

 

Mr. Cumston thanked Ms. Somerlot and Mr. Meade for coming this evening and speaking on behalf of ConAgra and Jobs & Family Services.

 

 

 

Bradley Hall, 659 Wood St – wanted to know if you can do work on Wood St. a lot of back up on Wood St for the last 6 years. Mayor Schertzer said he will check with Roger Baldinger to see if there is any history of back up on Wood St.
