ORDINANCE AUTHORIZING THE MAYOR FOR THE CITY OF MARION, OHIO TO COMPLETE ALL ACTS NECESSARY TO ENTER INTO AND COMPLETE THE SALE OF CERTAIN REAL PROPERTY LOCATED WITHIN THE MARION AIRPORT INDUSTRIAL PARK TO RECONSERVE OF OHIO, INC. OR THEIR DESIGNATED AFFILIATED ENTITY AND DECLARING AN EMERGENCY

 

            WHEREAS, ReConserve of Ohio, Inc. wishes to Purchase a parcel of land in the Marion Airport Industrial Park to complete an Eight (8) Million Dollar investment in a new industrial processing facility, and

 

            WHEREAS, said real property is not otherwise required for the City's purposes; and such use thereof would benefit and promote the industrial and economic welfare of the City, and provide employment opportunities for its citizens, and

 

            WHEREAS, The Marion Area Community Improvement Corporation (CIC) has previously been designated an agency of the City to act as City's agent facilitating the direct sale of lands to an identified purchaser and the Council finds upon the receipt of the necessary approval Resolution form the CIC the City shall proceed with the sale and purchase transaction,

 

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 

            Section 1.   The Council hereby finds a certain parcel of real property located with the City's Airport Industrial Park to be no longer necessary for any municipal purpose and therefore hereby authorizes the Mayor of the City of Marion to complete all acts necessary including but not limited to entering into a purchase and sale agreement and thereafter completing the transaction with ReConserve of Ohio, Inc after receipt of the Resolution of approval from the City's designated agency The Marion Area Community Improvement Corporation (CIC)  all in order to facilitate industrial development within the City's Industrial Park by ReConserve of Ohio, Inc..

 

            The certain parcel of real property containing approximately 20 acres located on Innovation Drive to be further delineated after receipt of the survey being completed by the purchaser under the direction of the City Service Director.

 

            Section 2.    That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

 

            Section 3   That this ordinance is hereby declared to be an emergency measure necessary for the safety and welfare of the City of Marion given the need to move forward to meet the established time lines of the parties and ensure the industrial development occurs at the proposed site and the inhabitants thereof and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
