ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH THE MOST QUALIFIED FIRM OF HAZEN & SAWYER FOR THE NPDES PERMIT COMPLIANCE SERVICES FOR THE CITY OF MARION, OHIO, APPROPRIATING THE NECESSARY FUNDS, AND DECLARING AN EMERGENCY
WHEREAS, City Council understands that the City of Marion is facing certain compliance requirements with its newly issued permit for the waste water treatment facility from the Ohio EPA dated September 30, 2013; and
WHEREAS, the City of Marion has determined that Hazen and Sawyer from Akron, Ohio to be the most qualified firm for these projects by an RFP and Quality Based Selection Process,
BE IT ORDAINED BY the Council of the City of Marion, Marion County, Ohio:
SECTION 1. That this Council hereby authorizes the Service Director to appropriate the necessary funds to enter into contract with Hazen and Sawyer for the NPDES permit compliance services for the City of Marion.
SECTION 2: The cost of the total contract ($448,400.00) for the above process will be paid for by the Sanitary/Sewer Improvement Fund 502.5003.5402.
SECTION 3. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare, and safety of the City of Marion and the inhabitants thereof and for the further reason that the WWTP should be in compliance with the EPA in a timely manner, and as such, shall take effect immediately upon its passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
