ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO EXTINGUISH THE REVERTER PROVISION CONTAINED WITHIN THE FORMER CONVEYANCE OF TITLE AS TO THE FORMER BOYS AND GIRLS CLUB OF MARION, AND DECLARING AN EMERGENCY

WHEREAS, the City of Marion, Ohio acquired title to 370 E. Mark St. from the defunct Marion Northeast Neighborhood Center, Inc in 1980 and thereafter leased said premises to the Boys and Girls Club of Marion until 1997 when it was determined to be advantageous to convey title to said premises to the Boys and Girls Club, and

 

            WHEREAS, by Ordinance 1997-119 Council authorized the conveyance of title while retaining a reverter provision to ensure the community continued to benefit from a neighborhood community center continuing to provide much needed programs, and

 

            WHEREAS, by separate Ordinances the City has facilitated the transfer of the former Lincoln Center from the Marion City Schools to the Boys and Girls Club of Marion which is now said Club's home and base of operations providing the community the expanded benefits associated with their newly acquired home, and

 

            WHEREAS, the Boys and Girls Club of Marion has advised it no longer has a use for the E. Mark St. property and has been approached by Habitat for Humanity of Marion which is desirous of obtaining title to said premises,

 

BE IT ORDAINED, by the Council for the City of Marion, Marion County, Ohio:

 

Section 1.   The Council after due deliberation has determined that the premises commonly known as 370 E. Mark St., Marion, Ohio conveyed to the Boys and Girls Club of Marion with a retention of a reverter provision should not revert to the City of Marion, Ohio. Further, the Council does hereby authorize the Mayor to execute any and all documents necessary to extinguish said right of reverter.  This to enable the conveyance of said parcel from the Boys and Girls Club of Marion to Habitat for Humanity of Marion without any restriction of record from the City as a former owner.

 

Section 2.       That this ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof, and for further reason Habitat for Humanity is ready to take over said property, and shall take effect and be in force immediately upon its’ passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
