ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO PREPARE AND ADVERTIZE A REQUEST FOR QUALIFICATIONS FOR NPDES PERMIT COMPLIANCE SERVICES AND ENTER INTO CONTRACT WITH THE MOST QUALIFIED INDIVIDUAL OR FIRM FOR THEIR PROFESSIONAL SERVICES, AND DECLARING AN EMERGENCY, as amended
WHEREAS, City Council understands that the City of Marion is facing certain compliance requirements with its newly issued permit for the waste water treatment facility from the Ohio EPA dated September 30, 2013; and
WHEREAS, These compliance requirements require competitive procurement of professional services; and
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:
SECTION 1. That this Council hereby authorizes the Service Director to prepare and advertize a Request for Qualifications and Request for Proposals to obtain services from an experienced and qualified firm, organization, or individuals familiar with the NPDES permit process.
SECTION 2: The cost of the contract for the above process will be paid for by the Sanitary/Sewer Improvement Fund 502.5003.5402. and the Service Director is authorized to enter into contract with the firm or individual.
SECTION 3. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare, and safety of the City of Marion and the inhabitants thereof and for the further reason that the WWTP should be in compliance with the EPA in a timely manner, and as such, shall take effect immediately upon its passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
