ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A LICENSE AGREEMENT WITH OHIO EDISON COMPANY TO ALLOW FOR THE CONSTRUCTION OF A WALKING/BIKE TRAIL LEADING TO SAWYER LUDWIG PARK, AND DECLARING AN EMERGENCY

WHEREAS, The City of Marion is constructing a walking/bike trail leading to Sawyer Ludwig Park and one of the spur access points to the main trail would go through Ohio Edison’s Property

WHEREAS, Ohio Edison has submitted their standard “OHIO LICENSE AGREEMENT” which is being reviewed and addressed by the City Park’s Director and the City Law Director,

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. That the Mayor be authorized to, after the appropriate issues are addressed, sign the Agreement or modified Agreement

Section 2. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to the imminent construction season and the need to move forward without further delay, and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
