ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH PARK ENTERPRISES, INC. FOR THE CONSTRUCTION OF THE A WALKING/BIKE TRAIL AT AND LEADING TO SAWYER LUDWIG PARK, AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 2013-37 authorized the Service Director to spec and bid for the construction of a walking/bike trail at and leading to Sawyer Ludwig Park, and

WHEREAS, Five companies responded, Park Enterprises was the lowest and best bid with $ 40,759.40 for Option 2, and

WHEREAS, Wing walls or equivalent will be needed at the installed culvert to keep the stone base and pavement from eroding, and several guide posts, and Park Enterprise Construction has given a price of $ 10,674.35 for the wing walls and $3,288.32 for the treated wood posts and rails, and

WHERAS, There are sufficient funds left to also install the remainder of Option 1, (for which Park Enterprise was also the lowest bidder) which price would, if authorized be at the same unit material prices as bid, and

WHEREAS, The issue of the License Agreement with Ohio Edison still needs formal approval before Option 1 could be completed


BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. That the Service Director be directed to enter into contract with Park Enterprises, Inc. for $54,722.07 (40,759.40 for Option 2 + $10,674.35 + 3,288.32 wing walls and guideposts).

Section 2. That the Service Director is authorized to also approve a change order to for construction of the remainder of Option 1 not already constructed under Option 2 at the unit prices bid. In no case, however should the total contract after change orders exceed $73,500.

Section 3. That said contract shall be payable with FY 2012 Community Development Block Grant money.

Section 4. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to the imminent construction season and the need to move forward without further delay, and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
