ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ACCEPT FAA 2013 GRANT AGREEMENT, PROJECT 21 AND ENTER INTO CONTRACT FOR IMPROVEMENTS , GRANT ADMINISTRATION FEES AND APPROPRIATE NECESSARY FUNDS FOR THE MARION MUNICIPAL AIRPORT AND DECLARING AN EMERGENCY

WHEREAS, Council by passage of Ordinance 2013-22 authorized the Service Director to prepare specifications and advertise for bids for construction improvements for the Marion Municipal Airport.

 WHEREAS, The City of Marion has been awarded $210,600.00 FAA (3-39-0050-2113) FY 2013 Grant known as Project 21. The total project will cost $234,000.00. The City of Marion’s share will be 10% or $23,400.00. These funds are available in Airport Improvement Fund.

 WHEREAS, the bid opening for Project 21 was held and the final grant was offered and accepted as a result of these bids. Project 21 has three (3) contracts and Project 21 Grant Administration and Engineering to award.

 BE IT ORDAINED by the Council of the City of Marion, Marion, County, Ohio:

 Section 1. That the Service Director is hereby authorized and directed to enter into contract with these companies for improvements at the Marion Municipal Airport.

1. Contract 1 – Storm Sewer Improvements
Park Enterprises, Marion, Ohio - $81,124.01
2. Contract 2 – Rwy. 7/25 Crack seal and Joint repair
P S Construction Fabrics - Wadsworth, Ohio $61,800.00
3. Contract 3 – Re-Paint Rwy. 7/25
Cummins Airfield Services, Marion, Ohio $18,751.00

Section 2. The specifications were prepared by G. A. Consultants, Inc. of Maumee, Ohio, who was selected per FAA guidelines and authorized by Ordinance 1997-111. Authorized to G. A. Consultants, Inc. Contract in the amount of $71,623.00 for inspection of construction and administration cost for Project 21.

Section 3. That the Service Director is hereby authorized and directed to appropriate the necessary funds from the Airport Improvement Fund for the City’s share of 10% or 23,400.00.

Section 4. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

Section 5. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the health, welfare and safety of the City of Marion and the inhabitants thereof, and to start the improvements as soon as possible before the construction season ends, and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
