ORDINANCE AUTHORIZING AND RATIFIYING THE SERVICE DIRECTOR'S PREVIOUS ACTS FOR THE REPAIR OF THE STORM SEWER ON HOLLAND ROAD WITHOUT FORMAL BIDDING AND ADVERTISING PURSUANT TO ORC 735.051, AND DECLARING AN EMERGENCY
WHEREAS, a storm sewer located on Holland Road has ruptured out and is in dire need of repair as a result of a significant storm event within the past 60 days,
WHEREAS, Service Director has previously retained Park Enterprises on a time & material basis for the repair of said storm sewer given the immediate and urgent need to act as the deterioration and failure continues to expand in area,
WHEREAS, the wastewater department is meticulously tracking hours expended, equipment used and inspecting the repair project
BE IT ORDAINED by the Council of the City of Marion, Ohio: Marion County,
Section 1. The Council determines and ratifies the previous actions of the Service Director determining and finding it necessary as an emergency under ORC 735.051 that the project be awarded without statutory letting procedures given the immediate need and real and present emergency presented specifically relate to this damage caused by a significant damage event occurring within the past 60 days.
Section 2. Authorization and ratification is provided the Service Director to enter into a time and material contract with Park Enterprises for the repair of the Storm Sewer on Holland Road.
Section 3. The cost of the project shall be payable from the Storm Water Sewer Fund 504.5008.5402 and shall include an affirmative obligation upon the Service Director to inform Council members every two weeks as to the costs expended / incurred through the date of the updated report.
Section 4. This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof: Due to the real and present need to move forward without delay to fix the ruptured storm sewer and reopen Holland Road ASAP; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
