ORDINANCE AUTHORIZING THE CITY OF MARION TO FILE AN APPLICATION TO THE STATE OF OHIO, TO PARTICIPATE IN THE CLEAN OHIO ASSISTANCE FUND (COAF) PROGRAM AND DECLARING AN EMERGENCY

WHEREAS, the State of Ohio Department of Development provides financial assistance to local governments for the purpose of addressing local needs, and

WHEREAS, the City of Marion desires to participate in the Program to receive financial assistance for the former Fairfield Engineering site, now known as CLARKSCO PROPERTIES, LLC, 240 Boone Ave, Marion Ohio under the Clean Ohio Assistance Fund and,

WHEREAS, the City of Marion has the authority to apply for financial assistance and to administer the amounts received from the State of Ohio, Jobs Ohio, Clean Ohio Assistance Fund, and

WHEREAS, the City of Marion must direct and authorize the CITY SERVICE DIRECTOR (CONTACT PERSON) assisted by the Planning Director, and CLARKSCO PROPERTIES, LLC to act in connection with the application and to provide such additional information as may be required:

BE IT ORDAINED, by the Council of the City of Marion, Ohio:

Section 1. The Council authorizes the Service Director as the Official representative of the City of Marion’s application to participate in the State of Ohio, Jobs Ohio COAF Program, and provide all information and documentation required in said application for the State of Ohio, Jobs Ohio Clean Ohio Assistance Fund submission.

Section 2. That the City of Marion hereby approves filing an application for financial assistance under the Clean Ohio Assistance Fund.

Section 3. That the City of Marion hereby understands and agrees that participation in the Program will require compliance with program guidelines and assurances.

Section 4. That CLARKSCO PROPERTIES, LLC hereby commits itself to provide the match as described in the application.

Section 5. That this Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its inhabitants thereof and for the further reason that a timely application could speed up rehabilitation at a local facility, which, if it is eventually partially demolished and partially renovated, could create employment opportunities, and as such shall take effect and be in force immediately upon passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall be effective from and after the earliest period allowed by law.
