ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO PREPARE PLANS AND SPECIFICATIONS, AND ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF A TRAIL AT AND LEADING TO SAWYER LUDWIG PARK WITH FY 2012 COMMUNITY DEVELOPMENT BLOCK GRANT MONEY, AND DECLARING AN EMERGENCY


WHEREAS, the City applied for and received Community Development funds to construct a trail from Uncapher Avenue to Sawyer Ludwig park for bikes and pedestrians, and

BE IT ORDAINED: by the Council of the City of Marion, Ohio, Marion
County,

 Section 1. That the Safety Director is authorized to prepare plans, specifications and advertise for bids to construct the trail, including work, as necessary, on a small bridge.

Section 2. That said contract shall be payable from FY 2012 Community Development Block Grant money.

Section 3. That this ordinance is hereby declared an emergency measure necessary for the immediate preservation of health, welfare, and safety of the City of Marion and the inhabitants thereof and for the further reason that a safer pedestrian and bike access is needed to the park and the grant funds must be expended fully this calendar year; and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
