ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH HELMS AND SONS EXCAVATING, INC. FOR THE MILBURN AVENUE AND MEADOW STREET SEWER IMPROVEMENTS PROJECT 10-1S, AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 2011-5 authorized the Service Director to spec and bid the street sewer improvements for Milburn Avenue and Meadow Street, Project 10-1S, and

WHEREAS, five companies responded, Helms and Sons Excavating, Inc. was the lowest and best bid with $1,064,750.

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. That the Service Director be directed to enter into contract with Helms and Sons Excavating, Inc. for $1,064,750.

Section 2. That said contract shall be payable from the Sewer Improvement Fund, Storm Water Improvement Fund, and OPWC.

Section 3. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to the imminent construction season and the need to move forward without further delay, and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
