ORDINANCE BY THE COUNCIL FOR THE CITY OF MARION, OHIO DECLARING A MORATORIUM PROHIBITING THE INTRODUCTION OF CHOLORAMINES TO THE WATER SYSTEM WITHIN THE CITY OF MARION, OHIO CREATING A PENALTY RELATED THERETO AND DECLARING AN EMERGENCY
WHEREAS, the Council at its meeting on the 28th day of May, 2013 was advised by Aqua Ohio water company representatives it intended to change the process of chlorinating the water system as to secondary treatment, and
WHEREAS, Council members having only an extremely limited opportunity to research and gather information regarding this change that will affect all of the residents of the City of Marion, Ohio,
effective June 1, 2013.
BE IT ORDAINED by the Council for the City of Marion, Ohio:
Section 1. The Council hereby declares a 45 day moratorium on the introduction of chloramines to the water system by any water provider within the City of Marion, Ohio. Further, Council establishes this prohibition as a law enforceable against any person or entity violating this prohibition during the declared moratorium period, which shall start on the date of the passage of this Ordinance and continue thereafter for a period of 45 calendar days. Any person or entity found to have violated this prohibition during the said period shall be subject to a fine of no less than Ten Thousand dollars ($10,000.00) per day for each day for which they inject chloramines during the moratorium period. Each day shall be a separate punishable offense.
Section 2. That this Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its inhabitants thereof: to afford Council the time necessary to conduct sufficient research to protect the health safety and welfare of the citizens of the City of Marion in relation to the additive chloramines; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
