ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO COMPLETE THE NECESSARY REQUEST FOR PROPOSAL PROCESS AND ENTER INTO CONTRACT FOR THE PURCHASE OF SOFTWARE AND HARDWARE FOR A DISPATCHING AND SCHEDULING PRODUCT TO BE USED BY THE MARION AREA TRANSIT (MAT) SYSTEM, ADVANCING THE NECESSARY FUNDS AND DECLARING AN EMERGENCY, as amended

 WHEREAS, The Marion Area Transit System (MAT) is in need of dispatching and scheduling software and hardware (“applications”) which are critical to the daily operations of the MAT system; and

 WHEREAS, the City of Marion was awarded the ARRA grant to purchase the applications for public transit operations and infrastructures for MAT; and

 WHEREAS, The City of Marion will pay for this project with the Ohio Department of Transportation (ODOT) reimbursing the City at 100% through a contract amendment; and

 BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 Section1. Council has been advised by the Administration of the ARRA project related to the Transit Department’s needs and ability to improve their operation via the purchase of dispatching, scheduling software and hardware applications for the daily operation of services throughout the City. Council hereby finds it to be in the best interest of the citizens of the City of Marion, Ohio to authorize the Service Director to conduct an R.F.P. process under the direction of ODOT and thereafter to enter into contract with the most responsive and best provider.

Section 2. Further, Council hereby authorizes (Contingent upon written confirmation received from ODOT for full reimbursement from ODOT/ARRA funding confirmed by ODOT) the Service Director to complete all necessary acts in order to purchase the dispatching, scheduling software and hardware applications for a total amount up to $125,000.00. Council has been advised by the Service Director the R.F.P. process has been completed, with ODOT over-sight, a local committee met, graded and chose the primary company of “Mobilitat” to furnish this software and with hardware coming from selected other vendors for MAT for a total amount up to $125,000.00.

Section 3. The above contract shall be paid for from funds advanced from the General Fund up to $125,000, which shall be reimbursed upon receipt of the aforementioned reimbursement from State and Federal funds 100%.

Section 4. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to immediate need to provide MAT updated equipment that is needed to enhance the performance of MAT as promoted by ODOT for transit system across the state, shall take effect and be in force immediately upon its passage and approval by the Service Director, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
