ROLL CALL – 8 members answered – Mr. Ratliff, Mrs. Blevins, Mr. Smith, Mr. Osborn, Mr. Daniels, Mrs. Gustin, Mr. Schaber, Mr. Edwards;
Mrs. Blevins moved to excuse Mr. Cumston and Mr. Thomas, Mrs. Ratliff 2nd. Roll Call: Ayes all, motion carried – Misters Cumston and Thomas are excused.

Mayor Schertzer presented a proclamation to Regional Planning for Fair Housing Month

Summary of Proceedings for March 25, 2013, Mrs. Blevins moved, Mr. Smith 2nd. Roll call: Ayes all, motion carried. Summary is approved.

OLD BUSINESS:

ORDINANCE 2013-13:
ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF MARION, BY REZONING LOTS 553 AND 554 ALSO KNOWN AS 443 N. STATE STREET FROM AN R-3 MULTI-FAMILY DISTRICT TO AN C-1B, NEIGHBORHOOD SHOPPING DISTRICT (Applicant, John Hochstetter)
Mr. Smith noted that this came out of Zoning and Annexation with a 3-0 recommendation for approval, this will be the 2nd reading tonight, with a public hearing on April 22, 2013. ORDINANCE 2013-13 HAS HAD ITS SECOND READING

ORDINANCE 2013-14:
ORDINANCE AMENDING SECTION 1143.015 (B) CONDITIONAL PRINCIPAL PERMITTED USES OF THE PLANNING AND ZONING CODE AS CONTAINED WITHIN THE MARION CITY CODE
Mr. Smith noted that this came out of Zoning and Annexation with a 3-0 recommendation for approval, this will be the 2nd reading tonight, with a public hearing on April 22, 2013. ORDINANCE 2013-14 HAS HAD ITS SECOND READING

NEW BUSINESS:

ORDINANCE 2013-17:
ORDINANCE AUTHORIZING THE CITY AUDITOR TO PAY A BILL FROM THE MARION MUNICIPAL COURT PURSUANT TO SECTION 5705.41(D)(1) OF THE OHIO REVISED CODE AND MAKING THE NECESSARY RE-APPROPRIATION IN THE MUNICIPAL COURT ASSISTANCE FUND FOR THE YEAR ENDING DECEMBER 31, 2013
Mr. Daniels stated that this came out of Finance with a 3-0 recommendation for approval, motion to suspend the rules, Mr. Osborn 2nd. Roll call: Ayes all, motion carried.

Matters not on the Agenda:

Major Bill Collins spoke: updated all on Marmet, Police Dept, etc. for the last 2 months. On Feb. 4 Chief Bell added 2 additional officers into Marmet. Sheriff Bailey added 1 –a total of 6 persons. 10-15 hour days, 6 days a week fighting drugs in the community. We are a part of a 10 county region. We are always generally at the top within the 10 regions. 42 cases of trafficking, 38 possessions. 163 new cases since January. 142.7 grams of heroin was confiscated. 54.4 grams of cocaine. Seized over 500 pharmaceutical pills since Feb 4. We have seized their property, which we are allowed to do, 40,000 over us currency. We do have a plan for the drugs that are coming in Marion. We are taking action and putting them behind bars. We have to have the Judges go along with us. Please give these guys the maximum sentence. We need to remain vigilant; our hopes are to keep this going.
Mrs. Blevins asked what do you do with the pills and other stuff. Major Collins said that everything is destroyed.
Dave Edwards asked about the currency. What happens with that? Mayor Collins said all that money goes into a strict Marmet fund for further drug buys, equipment, vehicles and so on.
Sulu Kelley 200 Barnhart St. – 10% should go to drug education programs – 4,000 for the programs. What is the relationship between Marmet and the Police Dept. as far as assets?
Chief Bell said there are no assets, they work out of this building, and we pay for everything. Mr. Kelley asked if any Marmet money gets transferred over to the Police Dept. Chief Bell said the County would answer that. Mr. Kelley said if Marmet gets an asset through forfeiture, does it go to the police dept. Chief Bell said no. Chief Bell said the employees of Marmet are the Police Dept, it’s important to state that.
