Mr. Thomas moved to excuse Mr. Cumston and Mr. Ratliff, Mrs. Blevins 2nd. Roll Call: Ayes all, motion carried – Misters Cumston and Ratliff are excused.

RESOLUTION ENACTED BY THE CITY OF MARION, MARION COUNTY, OHIO, HEREINAFTER REFERRED TO AS THE LOCAL PUBLIC AGENCY (LPA), IN THE MATTER OF PAVEMENT REPAIRS AND RESURFACING OF STATE ROUTE 309 AND DECLARING AN EMERGENCY
Mr. Thomas noted that this came out of Streets & Sewers with a 3-0 recommendation for approval, I move to suspend, Mrs. Blevins 2nd; Roll call: Ayes all, motion carried.

ORDINANCE 2013-13:
ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF MARION, BY REZONING LOTS 553 AND 554 ALSO KNOWN AS 443 N. STATE STREET FROM AN R-3 MULTI-FAMILY DISTRICT TO AN C-1B, NEIGHBORHOOD SHOPPING DISTRICT (Applicant, John Hochstetter)
Mr. Smith stated that this came out of Zoning and Annexation with a 3-0 recommendation for approval, I would like a first reading tonight. ORDINANCE 2013-13 HAS HAD ITS FIRST READING

ORDINANCE 2013-14:
ORDINANCE AMENDING SECTION 1143.015 (B) CONDITIONAL PRINCIPAL PERMITTED USES OF THE PLANNING AND ZONING CODE AS CONTAINED WITHIN THE MARION CITY CODE
Mr. Smith stated that this came out of Zoning and Annexation with a 3-0 recommendation for approval, I would like a first reading tonight. ORDINANCE 2013-14 HAS HAD ITS FIRST READING

ORDINANCE 2013-15:
ORDINANCE MAKING AN ADDITIONAL APPROPRIATION IN THE PARKS DEPARTMENT FUND FOR THE YEAR ENDING DECEMBER 31, 2013 FOR UTILIZATION OF DONATIONS FROM VARIOUS ORGANIZATIONS

ORDINANCE 2013-16:
ORDINANCE ELIMINATING A LIEUTENANT POSITION WITHIN THE POLICE DEPARTMENT IN ORDER TO RESTRUCTURE SAID DEPARTMENT TO BETTER SERVE THE CITIZENS OF MARION AND DECLARING AN EMERGENCY

Matters not on the Agenda:

Mr. Daniels spoke on the Quarry Park, the kilns were removed, and a lot of trees and bushes were removed and leveled. These things are not coming back. He wondered why there was no public input. He handed out pictures for all to look at.
Mayor Schertzer spoke of the safety reasons concerning the kilns, they were in bad shape and falling down. The Parks Commission has spoken about this for a while. Nature has a way to reclaim. The decision was for safety.
Mr. Osborn said the kilns had a lot of history. It would have been nice to have the knowledge of what was going to happen.
Mrs. Gustin said we didn’t have the opportunity to have our say. Did you look into preservation in instead of destroying it? It should have been brought to us. What’s done is done now.
Park Superintendent, Mike Cheney spoke on how the honeysuckle that is out there is in overgrowth. It impedes the trails. This work would make the park safer by bringing down the kilns which he knows that children climb inside them. The decision was made by the Park Commission and a farmer who in turn is doing the work for the lime mound that sits in the park.
Mayor Schertzer said he supports Mike Cheney and the Board’s decision.
Mr. Cheney said he wants to have the project done by 2014. New trees and trails will be planted and made, a new parking lot and the ability to go to one quarry from the other one. The visibility will be improved; we need a more family oriented atmosphere. The mention of fences came into play. Mr. Cheney said they had tried fencing off the cliffs, and the fencing was gone within 5 hours. We never did find the fence. Mr. Schaber asked about spec and bidding out the project. Mr. Cheney said it was a trade of material for labor. The farmer came to us with the proposal.
