ORDINANCE AMENDING SECTION 1143.015 (B) CONDITIONAL PRINCIPAL PERMITTED USES OF THE PLANNING AND ZONING CODE AS CONTAINED WITHIN THE MARION CITY CODE

WHEREAS, the City Planning Commission has recommended a change to the existing zoning code at the direction of Marion Regional Planning, and

WHEREAS, the Zoning and Annexation Committee has recommended the change be adopted as is provided and drafted by the Marion Regional Planning, and

WHEREAS, the Council finds a real and present need to amend the existing code in order to serve the people of the City of Marion.

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

SECTION 1. Marion City Code Section 1143.015 (B) now reading in part as follows:

(B) Conditional principal permitted uses. The following shall be permitted as principal uses only when approved by the Board of Appeals, as provided for in § 1171.02:

(1) Public utility substations, subject to the provisions of § 1163.04.

(2) Veterinary clinics, restricted to dogs, cats or other small household pets, without the boarding of said animals on the premises. All structures to be located at least 100 feet from any residential structure.

(3) Any other business or commercial use determined by the Board of Appeals to be of the same general character as those permitted in division (A)(3) or (4) of this section, but not including any uses first listed as permitted in the I 1 District.

Shall be amended to read as follows:

(B) Conditional principal permitted uses. The following shall be permitted as principal uses only when approved by the Board of Appeals, as provided for in § 1171.02:

(1) Public utility substations, subject to the provisions of § 1163.04.

(2) Veterinary clinics, restricted to dogs, cats or other small household pets, without the boarding of said animals on the premises. All structures to be located at least 100 feet from any residential structure.

(3) Any other business or commercial use determined by the Board of Appeals to be of the same general character as those permitted in division (A)(3) or (4) of this section, but not including any uses first listed as permitted in the I 1 District.

(4) Building Contractor’s Equipment Yard located in the C-5 General Business District will be evaluated for approval by the Board of Zoning Appeals, so long as the applicant provide for the following detailed descriptions which shall be considered a continuing obligation to operate within the parameters of same at the approved site.



a. Location is adjacent to an Industrial Zoning District.
b. Specification of daily hours of operations.
c. Identification of materials and equipment to be stored on site.
d. Any other information deemed necessary by the Board of Zoning Appeals.

SECTION 2. This ordinance shall become effective from and after the earliest period allowed by law.
