ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ENTER INTO A RENEWAL AGREEMENT WITH VOLUNTEER ENERGY SERVICES IN REGARD TO THE CITY OF MARION NATURAL GAS AGGREGATION PROGRAM AND DECLARING AN EMERGENCY
WHEREAS, the Council did by previous Ordinance enable the general election measure conducted on the 6th of November, 2001, which was successful and created the City of Marion Natural Gas Aggregation Program pursuant to O.R.C. 4928.20, and
WHEREAS, the Council by previous Ordinance authorized the entering into contract with both the E Group, a subsidiary of First Energy Solutions Corp. for program management services for more than 12 years and Volunteer Energy Services as the provider of natural gas under the program for more than four years, and
WHEREAS, Council finds a real and present need to renew the aforementioned relationship in regard to Volunteer Energy Services to continue the successes enjoyed in the past in regard to the City’s Natural Gas Aggregation Program.
BE IT ORDAINED by the Council for the City of Marion, Ohio:
Section 1. The Council hereby authorizes the Service Director to renew the relationship through contractual agreement with Volunteer Energy Services for both the provision of supply and Program management upon terms approved by the City Law Director.
Section 2. This Ordinance is hereby declared to be an emergency necessary under ORC 735.051 given the time tables associated with the provision of natural gas supply and the recent Statewide letting / PUCO approved results all for the benefit and welfare of the people of the City of Marion thereof due to the need to move without delay to continue the provision of savings to Program participants; and as such shall take effect and be enforce immediately upon its passage by two thirds vote of all members elected and by approval of the Mayor, otherwise it shall become effective from and after the earliest period allowed by law.
