ORDINANCE AUTHORIZING THE CITY OF MARION TO TAKE TITLE TO THE FORMER OAK STREET SCHOOL FROM MARION CITY SCHOOLS AND AUTHORIZING THE TRANSFER OF SAME TO THE BOYS AND GIRLS CLUB OF MARION COUNTY, OHIO BY
THE CITY OF MARION,OHIO'S DESIGNATED AGENT THE COMMUNITY IMPROVEMENT CORPORATION (CIC) PURSUANT TO ORC 1724.10 AND DECLARING AN EMERGENCY

WHEREAS, the Administration and Council through its Pro Tem have advised the Marion City Schools and the Boys and Girls Club of Marion County have presented a plan for the reutilization of the former Oak Street School, and

WHEREAS, the Council has previously designated the Community Improvement Corporation(CIC) to act as its agent under authorities found within ORC 1724.10, et al., and

WHEREAS, the Marion City Schools has, under its authorities contained within Title 33 of the ORC offered the former Oak St. school to the entities listed to whom it must offer first option to said site and they have passed or failed to exercise their statutory rights, and

WHEREAS, the Council is convinced the proposal offered by the two parties is in the best interests of the citizens of the community,

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. The Council by previous act has designated the Marion Area Community Improvement Corporation (CIC) an agent of the City under 1724.10 of the ORC. The Council finds it to be in the best interests of the people of the City of Marion and the Marion Community to authorize the City to take and accept Title to the real property commonly known as the former Oak St School (most recently utilized as the City Schools Lincoln Center). Further, Council directs and authorizes upon receipt of said Title the CIC, as the City's agent, transfer said Title for the sum of one (1) dollar as full consideration to the Boys and Girls Club of Marion County, Ohio. Council finding and determining said transfer of title is necessary to promote the health, safety, morals, and general welfare of the people of the political subdivision, stabilize the economy, provide employment, and assist in the development, rehabilitation and reutilization of vacant, abandoned or other real property within the subdivision. Both the CIC and the Mayor are fully authorized to complete all actions necessary to effectuate the transfer of title all pursuant to the aforementioned statutory authority.

Section 2. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to immediate need to transfer title without delay to enhance development and reutilization of a vacant structure and not cause any delay with the funding sources available, and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
