RESOLUTION AUTHORIZING THE MAYOR TO FILE AN APPROPRIATION ACTION FOR CERTAIN REAL ESTATE NECESSARY FOR THE IMPROVEMENT OF A TRAFFIC SIGNAL PROJECT, AND DECLARING AN EMERGENCY
Whereas, Section 163.05 of the Ohio Revised Code provides for an appropriation action to be filed where all of the requirements of Sections 163.04 and 163.041 have been met.
Whereas, these requirements have been met in connection with this project and no reasonable accommodations can be reached with the property owners.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Marion, Marion County, Ohio:
Section 1. The Council finds that it is necessary for a public use that this land be appropriated.
Section 2. That the Mayor is authorized to commence an appropriation action.
Section 3. That this Resolution is hereby declared to be an emergency measure necessary for the immediate need to proceed without delay of the appropriation of such land as same is declared necessary by Council for the enhancement of the traffic signal, the resolution shall take effect and be in force immediately upon its passage and approval by the Mayor, provided that it receives the affirmative tore of two thirds of all members elected to Council, otherwise it shall be effective from and after the earliest date allowed by law.
