RESOLUTION AUTHORIZING THE CLERK OF CITY COUNCIL TO FILE WITH THE BOARD OF ELECTIONS OF MARION COUNTY A COPY OF ORDINANCE NO. 2012-54, LEVYING AN ADDITIONAL INCOME TAX OF ONE QUARTER OF ONE PERCENT (.25%) IN THE CITY OF MARION, OHIO AND SPECIFYING NOVEMBER 6, 2012 AS THE DATE OF ELECTION TO BE CONDUCTED ON THE LEVY OF SAID ADDITIONAL INCOME TAX, AND DECLARING AN EMERGENCY

WHEREAS, the Council of the City of Marion, Ohio has adopted Ordinance No. 2012-54, levying an additional income tax of one quarter of one percent (.25%) in addition to the present 1.75% income tax; and

WHEREAS, it is necessary to have an election on a tax on income at a rate in excess of one percent pursuant to the Ohio Revised Code 718.01(C),

BE IT RESOLVED by the Council of the City of Marion, Marion County, Ohio,

Section 1. That the Clerk of City Council of Marion, Ohio is hereby authorized and directed to file a certified copy of Ordinance No. 2012-54 with the Marion County Board of Elections. Said Ordinance shall be filed by the Clerk with the Board of Elections together with a certified copy of this resolution on or before August, 8, 2012.

Section 2. That it is hereby specified that the date of election for the additional one quarter of one percent (.25%) to the existing 1.75% the increase being in excess of the statutory one percent tax shall be November 6, 2012, and that the Marion County Board of Elections is hereby directed to conduct the election.

Section 3. That the ballot at said general election on November 6, 2012 shall be in the following form:

“Shall the Ordinance providing for an additional one-quarter percent of one percent levy on income for the municipal operations of the City of Marion, at the rates set forth hereafter: for the Provision of Safety Services at the rate of 40 % of the one quarter of one percent for the Police Department; at the rate of 40% of the one quarter of one percent for the Fire Department; at the rate of 10% of the one quarter of one percent for dispatch services/disaster services; For the Provision of Street Improvements 10% of the one quarter of one percent for Streets Department, be passed?

FOR THE INCOME TAX
AGAINST THE INCOME TAX”

Section 4. This resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, or safety of the City of Marion, and for the further reason that the deadline for filing with the Board of Elections is August 8, 2012; and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall become effective from and after the earliest period allowed by law.
