ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH JONES & HENRY ENGINEERS, LTD. FOR THE DESIGN AND PREPARATION OF NECESSARY PROJECT DOCUMENTS FOR THE MERCHANT, VINE, S. GREENWOOD, MT. VERNON, DURFEE AND AN ALLEY BETWEEN MAIN AND STATE SEWER LINING PROJECTS AND DECLARING AN EMERGENCY UNDER ORC 735.051, AND DECLARING AN EMERGENCY

WHEREAS, the Service Director and Engineer have informed the Council of the recent discovery of sewers which have deterioration to the extent they are in immediate need for lining to attempt to avoid significant costly sewer replacements, and

WHEREAS, the City recently utilized to satisfaction the design firm of Jones & Henry Engineers, Ltd said firm having been evaluated in previous projects utilizing ORC 153.65 and the grading and selection process provided by law therein,

BE IT ORDAINED by the Council of the City of Marion, Ohio: Marion County,

Section 1. Based upon the report provided by the Service Director and the Engineer in regard to the recent discovery of sewers which have deterioration to the extent they are in immediate need for lining to attempt to avoid significant costly sewer replacements. Further Council recognizes the recent work performed by the firm of Jones & Henry Engineers, Ltd said firm having been evaluated in previous projects utilizing ORC 153.65 and the grading and selection process provided by law therein. Now Council declares an Emergency under ORC 735.051 finding a real and present need to forgo timely letting and finds it necessary for the best interests of the people of Marion to authorize the Service Director to enter into contract with Jones & Henry Engineers, Ltd for design and preparation of all necessary project documents as to the Merchant, Vine, S. Greenwood, Mt. Vernon, Durfee and an Alley between Main and State sewers.

Section 2. The cost of the project shall be payable from the Sewer Replacement Funds.

Section 3. This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof: Due to the real and present need to move forward without delay given the imminent threat of a much great cost being incurred if the sewers are not lined without further delay; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
