ORDINANCE TO PROVIDE FUNDS FOR THE PURPOSE OF GENERAL OPERATIONS AND OTHER MUNICIPAL PURPOSES OF THE CITY OF MARION, OHIO, BY LEVYING AND ADDITIONAL INCOME TAX AT THE RATE OF ONE-QUARTER OF ONE PERCENT (.25%), COMMENCING ON AND AFTER JANUARY 1, 2013, AND DECLARING AN EMERGENCY

Whereas, it is determined that it is necessary for the daily operation of the City of Marion, Ohio to levy an additional tax on income in excess of the present rate of 1.75 percent, said additional tax to be in the sum of the total of one-quarter of one percent.

Be it Ordained by the Council of the City of Marion, Marion County, Ohio:

Section 1. To provide funds for the municipal operations as set forth hereafter, there be and is hereby levied an additional income tax upon those classes of earnings and income as are set forth in Section 3 of Ordinance No. 1971-130, as amended, For the Provision of Safety Services at the rate of 40 % of the one quarter of one percent for the Police Department; at the rate of 40% of the one quarter of one percent for the Fire Department; at the rate of 10% of the one quarter of one percent for dispatch services/disaster services; For the Provision of Street Improvements 10% of the one quarter of one percent for Streets Department; the total of which is 100% of the additional tax of one-quarter of one percent, from and after the first day of January, 2013.

Section 2. The additional income tax imposed by Section 1. hereof shall be collected and enforced as provided in the City of Marion's Income Tax Ordinance No. 1971-130, as amended, and Rules and Regulations, being Resolution No. 1971-58, as amended.

Section 3. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

Section 4. This Ordinance is declared to be an emergency measure necessary for the immediate preservation of the health, welfare and safety of the City of Marion, and the inhabitants thereof and for the further reason that the deadline for filing with the Board of Elections is August8th, 2012; and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise, it shall become effective from and after the earliest period allowed by law.
