2012-16

 RESOLUTION TO REQUEST THAT THE MARION COUNTY COMMISSIONERS BE THE LEAD GOVERNMENT IN APPLYING FOR “MOVING OHIO FORWARD GRANT FUNDS”; AUTHORIZING THE MAYOR AND LAW DIRECTOR TO ENTER INTO ALL NECESSARY AGREEMENTS WITH THE MARION BOARD OF COUNTY COMMISSIONERS, AND IF NECESSARY, THE MARION COUNTY PROSECUTOR OR MARION CITY LAW DIRECTOR, TO PARTICIPATE IN OBTAINING FUNDS FOR DEMOLITION INCLUDING PROPERTIES WITHIN THE CITY; AND AUTHORIZING THE MARION COUNTY REGIONAL PLANNING COMMISSION TO ADMINISTER THIS COUNTY/CITY GRANT WITH THE ASSISTANCE OF AN EIGHT(8) MEMBER “NEIGHBORHOOD STABILIZATION PROGRAM/ MOVING OHIO FORWARD”(NSP/MOF) COMMITTEE, AND DECLARING AN EMERGENCY

WHEREAS, This Council recognizes the need to demolish unsafe and blighted vacant and abandoned structures; and

WHEREAS, the Mayor, Law Director, Safety Director, Board of Building Appeals, Council, with the assistance of Engineering Inspection and the City Auditor, have joined forces with the County of Marion to use Neighborhood Stabilization, and Community Development Block Grant funds to work as a team to eliminate dangerous structures, and

WHEREAS, the Ohio Attorney General’s Office has made mortgage settlement funds, the result of the compliance effort of the federal government and state attorney generals, available to counties if an application is approved, and

WHEREAS, the Ohio Attorney General’s Office has made it clear it wants only applications that address needs of the whole county, and

WHEREAS, given the City of Marion was the lead on the NSP grant and it is felt that it is the County’s turn to be the lead then on this next grant,and

WHEREAS, in either of the demolition grants, the lead agency determination is separate from the determination of the target area and selection of homes,

BE IT RESOLVED: By the Council of the City of Marion, Marion County Ohio:

Section 1. That this Council requests that the Marion County Commissioners be the lead government in applying for “MOVING OHIO FORWARD GRANT FUNDS” and that the Mayor and Law Director be authorized to enter into all necessary agreements with the County Commissioners and, as determined necessary by the NSP/MOF Committee, to participate in obtaining funds and implementing a demolition program including Properties within the City.

Section 2. Council authorizes the Marion City/County Regional Planning Commission to Administer this County/City Grant if received with the assistance of an Eight(8) member “Neighborhood Stabilization Program/Moving Ohio Forward” (NSP/MOF) Committee, which will include four(4) members from the City,

Section 3. Given the grant guidelines just came out and the application is due June 30th 2012, this resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the peace, welfare, and especially safety of the City of Marion and the inhabitants thereof, provided it receives the affirmative vote of two thirds of all members elected to Council; it shall become effective from and after the earliest period allowed by law.
