ORDINANCE AUTHORIZING THE MARION MUNICIPAL COURT TO ENTER INTO AN AGREEMENT WITH STATE OF OHIO ATTORNEY GENERAL’S OFFICE TO COLLECT DELINQUENT DEBT WITH CERTAIN APPROVED TERMS AS PRESENTED
WHEREAS, the Marion Municipal Court Clerk has advised the State of Ohio General Assembly recently amended State Code to allow a Court to certify past due fines, costs and civil costs as debt qualifying same for collection by the State Attorney General as monies due an Ohio Governmental entity, and
WHEREAS, the Municipal Court Clerk has advised of the current procedures related to the Court's collection activities as to fines and costs, and, further advised that current practices will continue as to debts owed up to twelve months, however the Court desires to utilized this new opportunity and refer debts older than twelve months, as more than ten other Ohio Courts have done, to the State of Ohio Attorney General’s Office for collection given they have unique capabilities, namely employer information access and tax refund set offs which all other debt collectors including local governments do not have access too,
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio
Section 1. That the Marion Municipal Court is authorized to enter into an agreement with the State of Ohio Attorney General’s Office to collect delinquent debt, to wit: fines, costs and civil costs upon terms contained in the provided proposed Agreement, including but not limited to: Court and AGO jointly waiving AG interest, Court and AG agreeing AG interest will not be assessed, AGO will not forward uncollected debt to either third party vendors nor special counsel. That the debt certified shall those debts older than twelve months old.
Section 2. This Ordinance shall take effect and be in force from and after the earliest period allow by law.
