ORDINANCE CREATING THE AQUATICS CENTER DEPARTMENT AND THE NECESSARY CODIFIED CHAPTERS AND SECTIONS, TO WIT: CHAPTER 148 AQUATICS CENTER DEPARTMENT AND DECLARING AN EMERGENCY
WHEREAS, the Council finding after significant investigation there is real and present need to make changes and modifications to how the City focuses its provision of recreational services to the community, and
WHEREAS, there is a real and present need to refine the previous Departmental structures in order to be the most efficient in providing the best chance of success at the new City Aquatic Center and providing recreational activities to the citizens, and
WHEREAS, Council finds it necessary to create the Aquatics Center Department and accompanying necessary sections,
Be it ordained by the Council of the City of Marion, Marion County, Ohio:
Section 1. The Council finds it necessary to create the Aquatics Center Department by enacting all necessary Sections within newly created Marion City Code Chapter 148 Aquatics Center Department,
148.01 City Aquatics Center Director
148.02 City Aquatics Center Fees and Charges
§ 148.01 CITY AQUATICS CENTER DIRECTOR
The Mayor shall appoint a City Aquatics Center Director who shall perform such duties as the Mayor may require.
§ 148.02 CHARGES ASSOCIATED WITH AQUATICS CENTER FEES AND CHARGES
The City Aquatics Center Director shall compile a Fee and Charges Schedule which shall be sufficient to sustain the City Aquatics Center Department in the manner in which an Enterprise Fund is maintained.
Section 2. Council hereby ratifies the funds previously designated by the City Auditor, to wit: Department 1026 Pool within Fund 602 Aquatics Center
Section 3. This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its inhabitants thereof: Due to need to act in concert with the dissolution of the Recreation Department and to immediately establish the necessary administrative structure to enable success at the City’s new Aquatic Center; and as such shall take effect and be in force upon passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall come effective from and after the earliest period allowed by law.
