ORDINANCE TO ESTABLISH A PROGRAMMATIC AGREEMENT FOR HUD FUNDED PROJECTS BETWEEN THE OHIO HISTORIC PRESERVATION OFFICE AND THE CITY OF MARION AND DECLARING AN EMERGENCY

WHEREAS; the City of Marion receives Community Development Block Grant and HOME funds, and

WHEREAS; coordinating with the Ohio Historic Preservation Office (OHPO) is required under the Section 106 Environmental review process, and

WHEREAS; the Ohio Historic Preservation Office offers communities the ability to streamline the review process if they agree to enter into a coordinated agreement for the administration of CDBG and HOME-funded activities, and

WHEREAS, the 2009 Programmatic Agreement between the City of Marion and OHPO expires on December 31, 2011

WHEREAS, OHPO has offered an amendment to the Programmatic Agreement that extends its duration, clarifies, the scope of exempt activities and includes additional administrative stipulations

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:
the City of Marion agrees to enter into agreement with the Ohio Historic Preservation Office for the administration of Community Development Block Grant and HOME funded activities.

Section 1. That the Mayor is hereby authorized to sign the agreement with the Ohio Historic Preservation Office and any and all other documents necessary in connection with said agreement

Section 2. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof and for the further reason that the grant application must be filed immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; it shall become effective from and after the earliest period allowed by law.
