ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO APPROVE A CHANGE ORDER WITH MAPLE CITY CONCRETE, LLC FOR THE 2011 SIDEWALK PROGRAM AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 2011 - 74 authorized applying and administering the FY 2010 CDBG Distress Grant which includes replacing sidewalks in the Northwest Neighborhood

WHEREAS, Ordinance #No. 2011 - 84 authorized the Service Director to enter into contract with Maple City Concrete, LLC in the amount of $38,791.60 and

WHEREAS, the FY 2010 Distress grant has $70,000 budgeted for this sidewalk activity, and Evelyn Warr-Cummings of Regional Planning is requesting a change order in the amount of $13,602 to add 3,208 square feet of sidewalks (802 linear feet) and 2 curb ramps to the project to maximize the advantage of low per unit prices and excess grant funds, and

WHEREAS, the proposed change order exceeds 15% of the bid price and therefore requires City Council approval

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. That the Service Director be directed to authorize a change order with Maple City Concrete, LLC, 92 S. Old State Road, Norwalk, OH 44857 in the amount of $13,602 bringing the contract total to 52,393.60 for the 2011 Sidewalk Project.

Section 2. That said contract shall be payable from the Community Development Block Grant FY 2010 Distress Program

Section 3. That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof: and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council: otherwise it shall become effective from and after the earliest period allowed by law.
