ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO CREATE AND IMPLEMENT A BICYCLE REHABILITATION PROGRAM IN COOPERATION WITH THE MARION CORRECTIONAL INSTITUTION GRANTING THE NECESSSARY AUTHORITY PURSUANT TO O.R.C. 737.32 AND DECLARING AN EMERGENCY
WHEREAS, the Council finds it to be in the best interest of the citizens of the City of Marion to enter into an agreement with Marion Correctional Institution (“MCI”) in order to rehabilitate bicycles which have been taken into possession of the City and which are unclaimed and return the bicycles, after refurbishing, to the community, and
WHEREAS, the Council finds the program as proposed by the representatives of MCI to contain merit and desires to proceed with said program,
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:
Section 1. The Council authorizes and directs the Mayor to create and implement a Bicycle Rehabilitation program in cooperation with MCI and other non-profit oriented organizations which may involve themselves in the aforementioned program known as B.I.K.E. standing for Believing in Kids Everywhere. Further, granting the Mayor the necessary authority pursuant to O.R.C. 737.32 to dispose of bicycles in the possession of the Police Department which are determined to be unclaimed pursuant to law by contributing said bicycles to the public agency MCI for refurbishing and return to the citizens of the community. Prior to implementation, the Mayor shall develop a plan in writing providing for the details and procedures to be applied, ensuring for the return of said bikes to the community, that no party profits momentarily from the program and the program is fair and just in its’ application.
Section 2. That this Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof; given the real and present need to implement the program and benefit the community as soon as possible; and as such shall take effect and be in force immediately upon its’ passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
