ORDINANCE AUTHORIZING AND DIRECTING THE SAFETY DIRECTOR ENTER INTO CONRACT WITH PAGE EXCAVATING FOR THE FY ’10 CDBG DISTRESS GRANT DEMOLITIONS, AND DECLARING AN EMERGENCY


WHEREAS, Ordinance No. 2010-55 authorized the preparation of specifications and advertising for bids for the Demolition of 191-193 Edwards St. and 1042 Bennett St. in the City of Marion, Ohio; and

WHEREAS, three bids were received and Page Excavating submitted the lowest and best bid of $15,050.00.

BE IT ORDAINED by the Council for the City of Marion, Ohio:

Section 1. The Safety Director be directed to enter into contract with Page Excavating for the FY ‘10 Distress Grant Demolitions Project.

Section 2. That said contract shall be payable for the Community Development Block Grant FY 2010 Community Distress Program.

Section 3. This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its’ inhabitants thereof: Due to the real and present need to move forward without delay given the need to take down such nuisance structures which are a public health threat and should be demolished as soon as possible, as such will immediately improve the safety and security of the impacted neighborhood; and as such shall take effect and be in force upon passage and approval by the Mayor provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise, it shall come effective from and after the earliest period allowed by law.
