ORDINANCE AMENDING THE FY 08 NEIGHBORHOOD STABILIZATION PROGRAM (NSP) GRANT TO PROVIDE FOR A PERMISSABLE TRANSFER OF FUNDS WITHIN THE GRANT AND DECLARING AN EMERGENCY


WHEREAS, Ordinance Number 2009-18 authorized the application and administration of the Fiscal Year 2008 Neighborhood Stabilization Program Grant, and

WHEREAS, the NSP grant has a variety of eligible activities, divided into three primary activities that the City has appropriated into three appropriation line items named: Demolition of Buildings, Housing Services, and Administration Fees, and

WHEREAS, the Ohio Department of Development, Office of Housing and Community Partnerships (OHCP) has acknowledged that it is permissible to transfer funds without a grant amendment between the Demolition and Housing Services Activities, and

WHEREAS, it was determined beneficial to transfer $86,000 from the Housing Services line item to the Demolition of Buildings line item to maximize the use of grant funds, Council hereby recognizing the successful management of the aforementioned Grant by the Neighborhood Stabilization Committee and the focused leadership found thereon in achieving the significant impact within the community, including but not limited to: The removal by way of demolition of 97 nuisance structures within the City of Marion, Ohio,

THEREFORE, BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. The Council hereby authorizes and approves the Transfer of $86,000 from Housing Services to Demolition of Buildings in the NSP grant.

Section 2. That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof: and is determined to be necessary in order to utilize grant funding which has time lines and numerous preliminary steps to utilize the funding all of which could jeopardize usage and the City of Marion does not desire to take risk associated with the non-utilization of grant funds herein, and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council: otherwise it shall become effective from and after the earliest period allowed by law.
