ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH SHELLY & SANDS FOR THE LINCOLN PARK ROADWAY PAVING PROJECT AND DECLARING AN EMERGENCY.
WHEREAS, Ordinance No. 2011 - 18 authorized advertising for bids for the Lincoln Park Roadway Paving Project, and
WHEREAS Only one bid was received for $42,400, and
WHEREAS, the FY 2009 Formula grant has $ 40,600 budgeted for this activity, and
WHEREAS, Shelly & Sands was the lowest and best bidder, and the scope of the project can be reduced by unit price to fit within the $40,600 budget.
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:
Section 1. That the Service Director be directed to enter into contract with Shelly & Sands Shelly and Sands, P.O. Box 1321, Mansfield, OH 44901, in the amount not to exceed $40,600 for the Lincoln Park Roadway Paving Project.
Section 2. That said contract shall be payable up to $40,600 from the Community Development Block Grant FY 2009 Formula Program
Section 3. That this ordinance is hereby declared an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof; and for further reason that these monies have to spent before June, 30, 2011; and as such, shall take effect and be in force immediately upon its passage and approval by the mayor, provided that it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
